The bars post "no smoking" signs. If someone chooses to smoke, it as at their own risk. If an inspector came in everyone would pay w/their livelihood.

Re: how well the ban will be enforced - the rule HERE is that the establishment gets the fine, NOT the smoker ($1,000 per incident). Nassau county enacted the ban a month earlier than NYC and it's ridiculous. ESPECIALLY IF YOU ARE SMOKING IN FARMINGDALE WHICH IS LIKE TWO SECONDS AWAY FROM SUFFOLK COUNTY WHICH HAS NO BAN. I mean honestly.

Cops being called to disperse smokers outside of a bar in Williamsburg. "Where are we 'sposed to go???" shout the drunken smokers. The cops look confused. Stand around for a bit, then ask the smokers to keep it down a bit. The smokers say, "Sure, whatever." Cops leave.

no kephm, I thought ppl might have stories about ppl drinking MORE because no ciggies, getting into fights, etc - I saw it happen, in fact I got physically manhandled out of the Turbonegro show in New York. after being told I couldn't nip out for a quick smoke I had the brazen audacity to walk BACK INSIDE. some other bouncer shouts something at me, i open the door back up and i'm like "what?" and he says "YOU HAVE TO GO DOWNSTAIRS!" i had no idea what he was talking about, so i shut the door. he ripped the door open and bearhugged me back out onto the sidewalk. the bouncer was insane, he had a crazed look in his eye, he was furious. all of his buddies were trying to pull him off me and tell him i'd just come out that way. i seriously thought i might get the shit kicked out of me, for TRYING TO FOLLOW THE RULES!! i showed him my stub and he let me back in EXTREMELY grudgingly. of course the bathroom ended up being a solid sheet of smoke.

I was outside a bar the other night where people were smoking and some guy was suggesting that all smokers stand outside bars and sing Sinatra tunes as loudly as they can to generate noise complaints and end the ban. I thought it was a pretty good idea. On the plus side though -- walking around the lower east side at night makes the city seem so lively cuz everyone's out on stoops smoking.

Uh, Stencil, I'm not sure how to say this any different way, but: there doesn't seem to be any evidence to suggest that he'd have acted any differently had he been asked by the bouncer to comply with any other rule of the place. I mean, if they'd walked into 7-11 with no shirts and shoes on and wound up killing the clerk over that, I don't think anyone would say "7-11's 'no shirt no shoes no service' policy is to blame for this man's death."

I mean, what I think this points to is that the new law suddenly creates a whole new burden of enforcement on bars and bouncers, which is certainly something to take into account. But I think it's ludicrous to say this man's death was a result of the smoking ban: it was a result of two guys being really uncooperative and going completely psycho when asked to comply with a pretty simple and well-known rule.

That's the thing I don't get, I mean you've basically now guaranteed that all patrons have to fight through an enormous cloud of second-hand smoke, ie the gigantic gaggle of smokers standing right outside the doorway. Plus half of these places have no ashtrays outside, so the streets look positively filthy.

The upshot of the outside though is it seems to encourage public silliness of the type you wouldn't see had everyone just been leaning in their barstools, puffing away. For example, me and two other lovely ladies danced around a midtown Irish pub on Saturday, demonstrating to passersby how we would dance if we were trying to be provocative at a bar mitzvah. Everyone outside would've missed that if not for Mike Bloomberg.

PS I don't think that the smoking is the real issue with that gentleman stabber.

Sorry, Stencil, I didn't mean to argue, I just don't understand what positions we're taking with regard to this. If you're saying this death was the result of bouncers now having to enforce a new and contentious rule, then sure: any time you create more rules for bouncers to enforce, there are more opportunities for stuff like this to happen. But if you're saying this guy's death is the "fault" of the smoking ban, then I guess I don't follow: when someone stabs a bouncer in a fight, chances are it has nothing to do with whatever started the confrontation and everything to do with just being the sort of psycho who stabs bouncers in fights -- over a cigarette, over someone spilling a drink on you, over being a dick to other patrons, over whatever. It looks to me like the smoking thing just happened to be the trigger in this case, but it could have been anything, right? "You looked at me funny?"

Yes, obviously the guy who killed him is guilty, but if there wasn't a smoking ban, the bouncer would've had no reason to throw them out of the bar! I don't think that's an "idiotic evaluation." The "Cig Ban" didn't kill him. But in a sense he did die as a result of having to enforce it.

bouncers used to hang out, check IDs, scold the occasional dope smoker, and break up the occasional fight but now it's like they're on active patrol! the "us vs them" quotient is upped exponentially. most bouncers i've met are actually pretty sweet but there are some with absolutely the wrong mentality whose judgement neurons, hanging by a thread, have snapped completely; i mean my condolences to the man's family, it's a horrible thing, but you don't have to put somebody in a choke-hold just to get them out of guernica for christ's sake

No doubt... but the smell of smoke hitting me on the way out is still funny to me. it was funnier on saturday night at the show at bowery ballroom than on Friday.

Friday was funny because when I went out for a smoke the first time, some absurdly friendly Canadian fellow joined me and started up a conversation by remarking that he wished to join my newly created "leper colony."

If nothing else, it enhances the already pronounced ability of smokers to start up random conversations about nearly anything simply by saying hello and remarking something about the current status of their shared addiction.

I will be quitting pretty soon myself, actually. Got a plan and all that stuff.

Yeah, I went out to an event on one of those sub-20s misery nights in February wearing only skimpy chiffon separates thinking, aw yeah, we have a driver, no need for a coat, and yelling my newly-coined catchphrase, "COATS ARE FOR LOSERS," SUCK IT, SUCKERS! and then because of traffic hell + also because all New York drivers pick up extra fares on the side leaving you to freeze, I basically had to stand on 8th avenue for like 40 minutes in the snow and freezing wind and then reconsidered that "Coats are for losers" was perhaps not the best New York in February catchphrase after all.
