But a person with knowledge of the governor’s role said that the person believes the governor is one of the men identified as clients in court papers.

The governor’s travel records show that he was in Washington in mid-February. One of the clients described in court papers arranged to meet with a prostitute who was part of the ring, the Emperors Club VIP on the night of Feb. 13.

Mr. Spitzer appeared on a CNBC television show at 7 a.m. the next morning. Later in the morning, he testified before a Congressional committee.

It's not just an hypocrisy issue with "lawbreaking," it's that it's not good to have the head of state government carrying a vested interest in a criminal operation, or in keeping a criminal operation secret. well if you're working and getting a check from a company for anything you do, you have to pay taxes on it. I think many of these companies work under shell companies (emporer's club has "emporer's publishing" for instance)...and the issue was that they told her they were paying the taxes, but didn't, so when she went to do her own taxes, she found out nothing had been withheld (and wasn't paid to her). this was a long time ago, so I can't really remember all the details.

I just wanted to tell you first that I cannot understand something like this happening to anyone. I have been through similar stuff that you have been through. I have hurt too. I have felt sad too. I had a family and watched her and my son leave me just for trying to get my life straight in school. It hurts, but I am making it. My whole point is just to keep your head up. I am not sure if you will ever read this from all the messages you have been getting, but just understand you have made it a long way. Maybe the way you got there wasnt exactly kosher, but it got you through, it got you there. You are a beautiful young lady with so much potential.

The Entrapment of Eliot

The federal criminal investigation that has led to Eliot Spitzer's resignation as governor of New York illustrates the great dangers all Americans face from vague and open-ended sex and money-transaction statutes.

Federal law, if read broadly, criminalizes virtually all sexual encounters for which something of value has been given. Federal money-laundering statutes criminalize many entirely legitimate and conventional banking transactions. Congress enacted these laws to give federal prosecutors wide discretion in deciding which "bad guys" to go after.

Generally, wise and intelligent prosecutors use their discretion properly -- to target organized crime, terrorism, financial predation, exploitation of children and the like. But the very existence of these selectively enforced statutes poses grave dangers of abuse. They lie around like loaded guns waiting to be used against the enemies of politically motivated investigators, prosecutors and politicians.

There is no hard evidence that Eliot Spitzer was targeted for investigation, but the story of how he was caught does not ring entirely true to many experienced former prosecutors and current criminal lawyers. The New York Times reported that the revelations began with a routine tax inquiry by revenue agents "conducting a routine examination of suspicious financial transactions reported to them by banks." This investigation allegedly found "several unusual movements of cash involving the Governor of New York." But the movement of the amounts of cash required to pay prostitutes, even high-priced prostitutes over a long period of time, does not commonly generate a full-scale investigation.

We are talking about thousands, not millions, of dollars. We are also talking about a man who is a multimillionaire with numerous investments and purchases. The idea that federal investigators would focus on a few transactions to corporations -- that were not themselves under investigation -- raises as many questions as answers.

Even if Mr. Spitzer's derelictions were serendipitously discovered as a result of routine, computerized examination of bank transactions, the dangers inherent in selective use of overbroad criminal statutes remain. Money laundering, structuring and related financial crimes are designed to ferret out organized crime, drug dealing, terrorism and large-scale financial manipulation. They were not enacted to give the federal government the power to inquire into the sexual or financial activities of men who move money in order to hide payments to prostitutes.

Once federal authorities concluded that the "suspicious financial transactions" attributed to Mr. Spitzer did not fit into any of the paradigms for which the statutes were enacted, they should have closed the investigation. It's simply none of the federal government's business that a man may have been moving his own money around in order to keep his wife in the dark about his private sexual peccadilloes.

But the authorities didn't close the investigation. They expanded it, because they had caught a big fish in the wide net they had cast.

In this case, they wiretapped 5,000 phone conversations, intercepted 6,000 emails, used surveillance and undercover tactics that are more appropriate for trapping terrorists than entrapping johns. Unlike terrorism and other predatory crimes, prostitution is legal in many parts of the world and in some parts of the U.S. Even in places like New York, where it is technically illegal, johns are rarely prosecuted. Prostitution rings operate openly, advertising "massage" and "escort" services in the back pages of glossy magazines, local newspapers and television sex channels.

If the federal government really wanted to shut down these operations, they could easily do it without a single wiretap or email intercept. All they would have to do is get an undercover agent to answer the ads, arrange for the "escort" to go from New York to New Jersey and be arrested. But many in law enforcement would much rather reserve these statutes for selective use against predetermined targets.

In this case, if the serendipitous bank audit really led federal agents to Mr. Spitzer, and Mr. Spitzer led them to the Emperor's Club, and federal prosecutors really wanted to get the Club, they could easily have sent an undercover cop to pose as a john, instead of tapping phones and reading emails -- tactics designed to catch and embarrass Mr. Spitzer with his own recorded words, which could be, and were, leaked to the media. As this newspaper has reported: "It isn't clear why the FBI sought the wiretap warrant. Federal prostitution probes are exceedingly rare, lawyers say, except in cases involving organized-crime leaders or child abuse. Federal wiretaps are seldom used to make these cases . . ."

Lavrenti Beria, the head of Joseph Stalin's KGB, once quipped to his boss, "show me the man and I will find the crime." The Soviet Union was notorious for having accordion-like criminal laws that could be adjusted to fit almost any dissident target. The U.S. is a far cry from the Soviet Union, but our laws are dangerously overbroad.

Both Democrats and Republicans have targeted political adversaries over the years. The weapons of choice are almost always elastic criminal laws. And few laws are more elastic, and susceptible to abuse, than federal laws on money laundering and sex crimes. For the sake of all Americans, these laws should be narrowed and limited to predatory crimes with real victims.

Cite your sources, please. I found three NJ records citing a 1975 DOB, but it's unclear if they are duplicate records documenting the same data error. I also see a NY record for a 1985 DOB .. which makes her 22 yrs old. Not much else out there. Not surprising if she's only 22 working in an underground economy (not much of a credit history).

Nevertheless, Senator Craig has resisted all pressure with his determination to serve out his term, so now some observers are wondering why Spitzer couldn’t do the same.

A few key differences highlight Spitzer’s far more vulnerable position:

1- He was exposed as part of a major investigation by federal authorities of a high-profile, criminal prostitution ring. Craig was exposed by a single cop running a little sting operation in the Minneapolis airport.

2- Other people will clearly go to jail as a result of the “Emperor’s Club” investigation that caught Spitzer. To the best of my knowledge, no one has actually gone to jail (in fact, one suspect was recently acquitted) in the Minneapolis Men’s Room operation.

3- Craig was caught with barely a year left in a long Senatorial career. Spitzer was caught after just one year of service in his first gubernatorial term. The inclination to let him “just serve out his term and then go away” is obviously much less when a wounded governor was supposed to serve for three more years.

4- Spitzer’s past prosecution of other prostitution rings, and strong condemnation of such operations, makes his inconsistency even more glaring than Craig’s. The fact that you’re trolling for sex in a men’s room, doesn’t logically require that you support gay marriage; even if Craig had supported same sex marriage, his bathroom bust would have been profoundly embarrassing. Ask anyone in online commerce: Turning browsers into buyers is hard. A conversion rate in the mid-single digits is above average. And it's even more difficult when you're talking about a) a novelty item and b) music, which people hate paying for anyway.

How many songs has Ashley sold? We don't know. Amie Street won't disclose sales info. So for argument's sake, let's say that each "listener" is a unique visitor, and that a phenomenal 5% of them actually bought a song. How much would she pocket?

At today's totals, our very generous estimate would be: 400,000 x .05 x 98 cents (price per song) x .70 (her estimated cut)= $13,720.

By the standards of the online music business, that would be a great number for a singer who was unknown before last week. But she couldn't retire on it.

The big picture: How much money can Ashley make from her newfound celebrity? We also don't know. We've guesstimated celebrity earnings in the past, and we're inclined to treat any report of potential book deals, endorsement offers, with heaps of skepticism -- grade inflation is rampant in these kind of stories, and there's not much in the way of fact-checking. (Though we do think Larry Flynt's $1 million Hustler offer is pretty solid. By most accounts, Larry is a trustworthy pornographer.)

Ashley will be able to sell the "exclusive" rights to her story and to future photo shoots, and that's worth something. But nothing like the money made by the magazines, TV shows -- and, yes, websites -- that are already selling her story and images already -- without giving her a penny.

Gov. David A. Paterson and his wife, Michelle, have both had extramarital affairs in the past, the couple said in an interview with The Daily News after he was sworn in on Monday.

Charles O’Byrne, secretary to the governor and Mr. Paterson’s top aide, said late Monday that he would have to review the story before commenting. An hour later, he said: “I’ve got nothing to say.”

In a series of interviews with The News in the past few days, Mr. Paterson said that he had an affair starting in 1999 and ending in 2001. It was not clear if he had subsequent relationships outside his marriage, and no details were given of any extramarital affair that Ms. Paterson may have had. But both described the period as a rough patch in their marriage that they worked through.

“This was a marriage that appeared to be going sour at one point,” The News quoted Mr. Paterson as saying. “But I went to counseling and we decided we wanted to make it work. Michelle is well aware of what went on.”

The paper quoted Michelle Paterson as saying on Monday: “Like most marriages, you go through certain difficult periods. What’s important is for your kids to see you worked them out.”

The governor said in the interview that he used a Days Inn at West 94th Street and Broadway for some of his romantic meetings but that he never used campaign money to pay for the rooms; payments to the hotel show up in Mr. Paterson’s campaign records for 2001, but he said that some of his staff members also stayed there. Payments to the hotel are listed in Paterson campaign records for 2002 and 2003.

The couple said they decided to speak to address rumors about their marriage that had been circulating in the capital. The revelation was the latest in Albany related to sex. Eliot Spitzer, the former governor, resigned after reports of his involvement in a high-priced prostitution ring became public last week.

The admission is likely to be a distraction for the new governor at a difficult time. The state faces a $4.4 billion budget deficit, a worsening economic outlook and just two weeks to negotiate a budget.

Legislative leaders were expected to begin negotiating a joint budget in earnest on Tuesday, but talk will undoubtedly dwell on the personal lives of the former governor as well as the new one.

However, an ex-prosecuting attorney and attorney general engaging in prostitution has more ramifications than just porking the secretary. It is law-breaking, whether you agree with the law or not.

Let's say this was Spitzer's attempt at civil disobedience, because he disagrees with the law against prositution. Still not off the hook. An inescapable part of civil disobedience is one's willingness to take the penalty of the law.

A: Someone sent me a VHS tape of a bunch of revelers getting arrested for public nudity at Lake Havasu, Calif., during spring break. Paterson pays back campaign for hotel tryst, but other bills raise eyebrows

Gov. Paterson says he's reimbursed his campaign for two hotel stays he can't explain while his aides' review found several cases where he used campaign money to pay for men's suits, furniture and bar tabs.

The reimbursements come after Paterson admitted to the Daily News that he may have used his campaign credit card to pay for a hotel visit with one of his lovers.

At the same time, Paterson's aides accused reporters of sexism for raising questions about campaign payments to women.

"In some cases the inquiries have bordered on sexist," said Errol Cockfield, Paterson's spokesman. "The governor has sought to be forthright. We've been very open and honest about these matters."

The personal payments, all of which Paterson later repaid, surfaced in an internal review by the governor's campaign lawyer, Henry Berger.

The payments included two overnights at the Quality Hotel on the Upper West Side paid for by Paterson's campaign. In both cases, Paterson said he can't recall the circumstances of the stay or even who stayed at the hotel on those nights.

"With two exceptions, we have found that all of the itemizations we examined seem to be proper," Berger said.

In trying to explain why he reimbursed a $1,430 American Express bill paid by his campaign, Paterson admitted several of the charges were for personal items such as clothing at the Men's Warehouse, items at the Taft Furniture Warehouse and drinks at an upper Manhattan bar called The Den.

I love to meet new people, but I often wish I could do it with having to overcome some of the less accurate public perceptions about me.

I am the first to admit that I’ve been blessed with a pretty remarkable life up to this point. I’m happy to share what I’ve learned from it with you. I’ve had some pretty amazing experiences over the years – some absolutely outrageous experiences -- and I’m happy to share those with you too.

It might be a stretch to say that I’m just your average Joe, but as you explore this site, I think you’ll come to find that my desires, dreams and disappointments aren’t terribly different from your own. A woman who helped run the prostitution ring in the scandal that brought down former Gov. Eliot Spitzer pleaded guilty to a pair of federal conspiracy charges Tuesday and called her former business "disgusting."

Cecil Suwal, 23, giggled and cried her way through a brief hearing at a federal court in Manhattan, then donned a pair of sunglasses and left quickly without speaking to reporters.
