Donald Tokowitz Sterling (born Donald Tokowitz; April 26, 1934) is an American business magnate and former attorney. He is the owner of the Los Angeles Clippers in the National Basketball Association (NBA). Sterling acquired the Clippers in 1981 for $12.5 million.

When [current Blazers assistant coach] Kim Hughes, then an assistant coach for the Los Angeles Clippers, was found to have prostate cancer on the eve of training camp in 2004, he learned what it was like to work in Donald Sterling's world.Hughes wanted to postpone surgery. The disease ran in the family, usually slowly. But after Coach Mike Dunleavy encouraged Hughes to get another opinion, the second doctor urged Hughes to have surgery quickly. When Hughes contacted the Clippers about his health insurance coverage, he was told the surgery was not covered. If they made an exception for him, they would have to do so for everyone. The cost would be $70,000.Hughes went ahead and had the surgery anyway. Unknown to him, four players - Chris Kaman, Corey Maggette, Elton Brand and Marko Jaric - chipped in to cover Hughes's cost for the operation.

Q: Can Silver force Sterling to say whether the voice on the tapes is his?A: Yes. Under the terms of Paragraph 24(m)(ii) of the "constitution" that governs the 30 owners of NBA teams and establishes the authority of the owners' commissioner, Silver can require Sterling to respond under oath to questions. The commissioner has "the right to require testimony and the production of documents and other evidence from any Member." As an owner, Sterling is a "member" of the NBA. Sterling and his lawyers could delay answering questions from Silver, but if Sterling refuses to admit or to deny that it is his voice on the tapes, he is in violation of the constitution and would face termination. He has no protection from the U.S. Constitution's Fifth Amendment guarantee against self-incrimination, because he is not facing any charge of any crime

Q: What penalties can Silver issue?A: Under the provisions of the bylaws, Silver has two sets of powers that he may use. Under either, he can issue a lifetime suspension and a substantial fine. Under Paragraph 24(l) of the constitution that was adopted by the NBA owners on Oct. 26, 2005, he can issue a fine of up to $2.5 million, can suspend an owner indefinitely and can order the forfeiture of draft picks....In another provision, Paragraph 35(A)(c), Silver can issue an indefinite suspension and a fine of $1 million to any owner who "makes ... a statement having or designed to have an effect prejudicial or detrimental to the best interests of basketball."

― tsrobodo, Tuesday, 29 April 2014 09:02 (eleven years ago)
another NBA owner suggested an interesting penalty, designed to use "soft-power" to pressure sterling to sell the clippers.
Like Cuban, Alexander interpreted the NBA constitution to not allow the commissioner to have the power to remove an owner except for gambling. However, Alexander said he suggested to Silver that all the Clippers players could be given the option to become free agents after this season, a step toward driving Sterling out of the league.
― Daniel, Esq 2, Tuesday, 29 April 2014 10:21 (eleven years ago)
FWIW, while I thought it was a little weird that Kareem focused so much on how the person who made the tape should be arrested, he is technically correct. California requires all parties consent to recording, and a violation appears to be a misdemeanor offense. Still kind of odd that he focused so much on that.
― Doritos Loco Parentis (Hurting 2), Tuesday, 29 April 2014 14:37 (eleven years ago)
I don't think he focused on it to any strange degree. He gives it two paragraphs in order to support his point that the "making and release of this tape are so sleazy" and that we probably should have been outraged over sterling's earlier offenses, which were more substantial and acquired through less sleazy means. It is the same point others have made on ILX, and it is OTM. There's nothing odd about it.

forbes article has an interesting perspective on sterling's likely reactions.
Sterling has yet to respond but people who are sure that he now must sell, take his $750 million profit and go (he bought the team in 1981 for $13 million, reportedly assuming $11 million in obligations, paying $2 million in cash), don’t know Donald.Insiders say he had to be talked out of attending Sunday’s loss to the Warriors in Oakland and doesn’t comprehend his predicament. A source told me he called Coach Doc Rivers to explain, but Rivers refused to discuss the matter. We’re not talking about everyday denial. This is someone who can tell his girlfriend, V. Stiviano—that’s what she was actually called—who describes herself as “black and Mexican,” not to “broadcast” a photo she took with Magic Johnson or bring African-Americans to Clipper games … where she often sat next to Sterling in the seat that would be otherwise occupied by Shelly Sterling.Sterling has great tolerance for chaos — he seems to revel in it. Alexandra Castro, the young woman he sued in 2004 when he acknowledged paying for sex, portraying her as a $500-a-night prostitute, is still often a guest at Clipper games.“Donald’s not wired to let all this in,” said a former staffer. “I’ll bet he’s preparing to sue the league for devaluing his franchise. The thing he’s mad about is that nobody is using the T in his name.”Sterling, born Donald Tokowitz, the son of a pushcart peddler in hardscrabble Boyle Heights, is now Donald Tokowitz Sterling. I lampooned him in open letters for 20 years in the Los Angeles Times and the only thing he ever complained about, aside from telling me, “I didn’t understand what you meant,” was the first one when I left out the T.Not that Sterling doesn’t have some defenders, or at least one. Noted Donald Trump, who presumably knows whereof he speaks: “He got set up by a very, very bad girlfriend. Let’s face it. She’s the girlfriend from Hell.”

The by-laws are clear. He's gone
Sterling might conceivably cook up a suit to challenge the legality of the NBA owners' agreement and seek a stay on the basis of 'irreparable harm' if he's forced to sell. If he succeeds in dragging this into court, he could hang onto the franchise for years. Otherwise, he's out of there as soon as the owners can vote on it.
― Aimless, Tuesday, 29 April 2014 20:32 (eleven years ago)
sounds like he's contemplating a lawsuit to allege the nba is driving down the current market value of his franchise. theoretically, that's a potentially viable claim that he might be able to bring outside of the nba's constitution.

well there's already a website that has pointed out that Sterling has donated lots of money to Democrats in recent years, trying to insinuate that the media is painting him as a 'stereotypical racist Republican' when he's really ONE OF YOU GUYS.
y'know even though nobody invoked anything remotely political until they brought it up but hey w/e

seen something similar to this a bunch too:
"I’m sorry, but this just isn’t right. And where does this end?
At the rate our society is moving, the outrage mob is just going to get hungrier and hungrier. Soon, disagreeing with gay marriage or believing that homosexuality is a Biblical sin will get you the same sentence that Sterling just got. It will be said to be as bad as making racist remarks."
OMG THE HORROR!! We must nip this in the bud or else bigory of ANY form might get similar punishment!!!!

On Monday, a man who answered the phone at Nehoray's law office wouldn't identify himself and said the attorney would no longer comment on the audio or Stiviano's case. He said the attorney was invoking the Fifth Amendment right against self-incrimination, citing a statement issued by the Clippers accusing Stiviano of embezzlement.
So the leaker looks like Stiviano's lawyer?

union's still pushing hard, too.
"I reached out to other players around the league and made it clear the players were ready to boycott the games if this type of action was not something that Adam Silver felt was necessary," Mason said. "We're happy with the decision but we're not content yet. We want immediate action. We want a timetable from the owners as far as when this vote is going to happen."

V. Stiviano “never wanted any harm to Donald,” Calabasas lawyer Mac Nehoray of Calabasas told The Times.
He said the 31-year-old is still reeling from the release of the recordings in which Sterling chastises her for associating with African Americans, including Magic Johnson. He said that “someone released it for money” but it wasn’t Stiviano.
“My client is devastated that this got out,” he said.
He also insisted that Stiviano and the 80-year-old Clippers owner never had a sexual or romantic relationship and descriptions of her as his mistress in the media and in a lawsuit filed by Sterling’s wife are erroneous.

The tension with Erman got weird. Midseason, the team moved Erman’s parking spot to a less convenient place, likely at the behest of Jackson or one of Jackson’s allies on the staff, per multiple sources familiar with the matter. They began changing his duties in strange ways.

i have no allegiance toward, or feelings one way or the other about, mark jackson, but didn't he support the warriors' plan to forfeit game five, in protest, over the sterling situation? that seems to cut against the notion that he's just manipulating the situation to gain a competitive advantage for his team.

It isn't as if Silver drilled a hole in Sterling's head and scooped out the thoughts inside, or that he hadn't done DECADES WORTH OF HORRIBLE SHIT prior, such as heckling his own goddamn player, threatening to evict a black tenant because she reported leaks. the people who would go to lengths to defend this guy are about as bad as him and deserve to be told to fuck off as well.

i'm down w/the sentiment but the execution felt less grassroots and more like a really slick ad campaign, like let's take this incident and boil it down to a three word catchphrase as quickly as possible.

Would we otherwise expect a city to be "weak" a year after a terrorist attack at a sports event? I get that it's a trauma, but it seems like such an easy self-pat on the back for something that didn't directly impact most people in the city. Three deaths and 140 injuries.

the whole city shuts down that day
you can imagine for a moment if you stop being a dick, how scared people would be. not just adults. kids, teenagers. have some compassion.
lol if by "entire neighborhood" you mean "5 towns and 60% of the city of Boston"
I am pretty cynical about BOSTON STRONG seeing as I brought it up here and all but I'm at least sensible enough to leave it at "I am pretty cynical about it" partially because I know someone who had her foot blown off and it seems beyond evil to be overly cynical about her actual missing foot
― chillin' on an "awesome pretzel" hoagie (DJP), Wednesday, 30 April 2014 19:15 (eleven years ago)
exactly. and even seeing it all (from a distance) happen at locations where you've been is scary and justifies a confidence building campaign.

it's perfectly understandable for a community to rally together when it is PHYSICALLY attacked, and to affirm that it is too strong to be made to cower in fear by its past or future attackers. it's one of the few times most American urbanites are able to tap into a sense of community and togetherness, I'm for it even if I kinda roll my eyes at some of it.

I actually kinda like these stories; obviously everyone is in a rush to tell stories articulating just how awful a guy this really was but I think that sort of ignores a bigger point - people like this get into money and power because they also know how to be affable and likeable when they need to be. Granted the Simmons story paints him to be as much of a weirdo as all the other ones do but it also shows a side that IMO is more dangerous.

Díaz, informed that Salon had tracked down his syllabi, assured us via email that the diversity of perspectives he emphasizes is less about the books than the approach. “I teach classic Gothic texts which are themselves not very diverse by our standards,” he said, “but the critical lens I deploy helps my students understand how issues of race, gender, coloniality etc. are never far and how these problematics in fact underpin even what what would be considered a ‘white text.’”
Sharing just a list of books, he feared, “feels like a shortcut—like throwing out Sterling from the NBA.”

"When I listen to that tape, I don't even know how I can say words like that. ... I don't know why the girl had me say those things," he told CNN's Anderson Cooper in an exclusive interview set to air on Monday.
"You're saying you were set up?" Cooper asked.
"Well yes, I was baited," Sterling said. "I mean, that's not the way I talk. I don't talk about people for one thing, ever. I talk about ideas and other things. I don't talk about people."

interesting study-project on the psychological impact of extreme wealth on someone's mind. once you're on-top, you are surrounded by people that always agree with you and reinforce your views. that can lead to extreme lack of self-awareness and the abandonment of sensible caution, both of which are on display with sterling (and, you know, your highly-successful drug kingpin).

full article.
― Daniel, Esq 2, Tuesday, 13 May 2014 22:26 (eleven years ago)
Assuming the owners officially vote Sterling out and then Sterling drags them to court, a boycott would not be a helpful thing. Legal issues take time to be resolved, and there's nothing Silver can do to change that. Sterling doesn't care if the players boycott. He's getting his check either way, and he is clearly does not care about public opinion. In fact, he seems to love the spotlight.
― polyphonic, Tuesday, 13 May 2014 22:29 (eleven years ago)
i assume the idea is to only boycott if, by the beginning of the next season, the owners haven't taken action to remove sterling. if they've done all they can do, and sterling has secured an injunction and tied-up the matter in court, i'm guessing the players will play (maybe not the clippers, tho).

http://sports.yahoo.com/blogs/nba-ball-dont-lie/report--donald-sterling-asked-v--stiviano-to-lie-to-the-nba--he-and-his-wife-are-not-estranged-002432972.html
some new behind the scenes reporting:
Stiviano told Anders that Sterling met with her on May 2, shortly before she was interviewed by ABC’s Barbara Walters. Sterling asked Stiviano to tell the NBA that she lied in her previous meeting with the league. The billionaire owner wanted her to tell the league investigators that the voice on the recording was not his and that she had altered the recording,
Stiviano said Donald Sterling requested that she pay Shelly Sterling to settle the lawsuit, filed in 2013, and that he would return the money to Stiviano through “back channels.”
It also says there is ample evidence that Sterling and his wife are not estranged, as has been suggested.
The Times report also further incriminates former Clippers president Andy Roeser, in the NBA’s eyes. Roeser was given access to the tapes weeks before they were released, from a team employee who received them from Stiviano, according to the report. Allegedly, Roeser knew that the voice on the tapes was that of Sterling, but kept a brave “that-might-not-be-Donald!” face both in a press release and in discussions with the NBA.

I know it's not what happened.
I know that Sterling is a douche who got caught being douchey and his co-owners wanted him gone for a while, and Silver knew he'd look awesome for doing it as early as he could.
BUT
Imagine just for a second that Sterling planned this whole thing. It is really not too far outside the realm of possibility. It would not take a Kaiser Soze or Petyr Baelish to pull this off.
I know it would have just been easier and less public and possibly more profitable (although I don't see how THAT'S possible) to just put the team up for sale, so I'm not sure if this was a thing that makes sense pragmatically. Like, would this brouhaha increase value? Possibly by way of publicity?
Thoughts?

ESPN's Ramona Shelburne adds that Sterling is still deciding whether to sue Shelly Sterling too. And here comes Woj, saying Sterling could file a separate suit to stop the sale of the team.

Former Clippers owner Donald Sterling and his wife, Shelly, have decided not to divorce, according to a filing in Los Angeles Superior Court.
“Notwithstanding all the difficult events of the last two years, the Sterlings have resolved their differences,” Donald Sterling’s attorney, Bobby Samini, wrote in an email to The Times on Friday.

Still not dead! Meantime that new Clipped series on Hulu based on the 30 For 30 podcast about Sterling and his fall started up today. A bit of a classic example of solidly mid-TV rather than anything truly great so far -- weird to think of 2014 as something to look back on nostalgically but in a real way it is just that -- but it gave Rembert Browne some writing room employment, and Lawrence Fishburne as Doc Rivers and Ed O'Neill as the sleazeball himself makes it at least watchable; Cleopatra Coleman as V. Stiviano ain't bad either but having a weird origin moment for the face shield is about what I would expect from this kind of production. (Also, randomly hilarious LeVar Burton cameos as himself thanks to him and Fishburne actually having regular heart to heart talks in saunas, per the new episodes of the podcast.)

i've seen sterling's testimony re: activities in his limousine referenced throughout trump's various trials
which is no doubt among the many reasons none of his lawyers will let him take the stand
