Fourteenth Amendment the most pliant. Loved that development in con law whereby big business used due process clause to invalidate minimum wage, max work hours, child labor laws, etc.

Eight Amendment, because America is a vengeful, bloodthirsty country, and without it we'd be hanging people for misdemeanor theft.

I love the 3rd, like, a lot, it's one of those "wow, they have to make a law about this" laws that I like to muse on and think about. but the 13th amendment is easily the most important one imo.

i guess the question is, which amendment would cause the most immediate sheer chaos if it was suddenly removed?

who is dankey kang (Karl Malone), Friday, 13 March 2015 16:49 (ten years ago)

#2 for practical reasons (civil war), but imo #1 is first for good reason - you need it before you can build a lot of these other rights

Probably a good thread for this - reminder that we came really, really close to having a gender equality amendment that ultimately died because maybe a hundred or so white dudes in state congresses didn't ratify it

as Reagan said, women are better than women, therefore they don't need the ERA.

21 in a landslide. In good times and in bad times, 21 is always there for you.

The amendment is one of the least controversial of the Constitution and is rarely litigated, with the American Bar Association calling it the "runt piglet" of the U.S. Constitution.[1] As of 2015, it had never been the primary basis of a Supreme Court decision.[2][3][4]

Corporations get on that, you're missing out on a potential revenue stream.
