I can see the purpose of this, and I can see how it fits with current interpretations of the Constitution ("running into your home after drunk-driving" = "running into your home with the bloody knife in hand") -- but to be honest I'm kind of more uncomfortable with the thought that police would take drunk drivers into car chases!

(Yeah, Kenan, consider also that the only way this would apply is if police actually tailed you right to your doorstep and into the house -- otherwise there's no evidence you weren't drinking inside. So it'd only really function in the small number of cases where the person was basically caught and just tried to ditch out and claim sanctuary in the home.)

I've already explained myself to you. I'm sorry your mom is Steve Jobs but you need to let go the idea that everyone must have a Mac your way.

That car pic is making me think of a recent DC news story, some guy managed to jump a highway and a metro entrance and crash his car a good 15 feet in the air into a Macy's or Hecht's or whatever they call it here. He then ran to try to get on the bus to get away. Absolutely epic.

I don't get this. As noted, the cops would have been tailing them anyway, presumably they would have flipped the lights on to pull them over, and the alleged lush kept driving home and ran inside. Can't the cops come in anyway, for the car chase/resisting arrest angle, even if it had absolutely nothing to do with drunk driving?

The case concerned the 2003 Santa Barbara arrest of Daniel Thompson, whom a neighbor suspected was driving drunk and notified authorities. They found a parked car matching the description the neighbor provided and went to the front door of the adjoining residence during a summer evening.

The door was open and a woman said the car's driver was asleep. Moments later, Thompson walked by the officers and they entered the house and arrested him. The neighbor confirmed it was the person she suspected of driving intoxicated and throwing an empty vodka bottle out the car door.

This reminds me of the time the cops hauled my brother off his front porch and sent him to detox. They gave him a breathilizer when he arrived. His blood-alchahol content was such that he could have legally driven himself to detox.
