SCOTUS overturns exclusionary rule for door kickdowns (with warrant)

Breyer's dissent noted that there are already plenty of exceptions to the knock-and-announce rule, including reasonable suspicion that it would expose police to danger or give suspects time to destroy evidence.

That's enough now. I'm tired of singing.

Instapundit and Kerr are not much happy either.

i think its "kick AT your front door," isnt it?

SQUARECOATS (plsmith), Friday, 16 June 2006 15:47 (nineteen years ago)

Well that would imply not connecting, wouldn't it? Whereas the obvious direction for an exterior door to go, assuming it's been kicked from the outside by a villainous jackbooted oppressor of liberty who is sufficiently sober to connect with the door he intends to assault is inwards.

Shadow of the Waxwing (noodle vague), Friday, 16 June 2006 15:50 (nineteen years ago)

I suppose it could theoretically be an interjection:

"When they - KICK IT! - your front door..."

But then you lose a verb.

The TPM cafe post has a good question in the comments that I have myself: So is illegal entry still illegal (meaning it would be fair game for a defense attorney to force the officer who discovered the evidence to admit he had committed a crime to obtain that evidence) or are the police now above the law?

the question is, how you gonna cum?

A Giant Mechanical Ant (The Giant Mechanical Ant), Friday, 16 June 2006 16:15 (nineteen years ago)

Patrick Henry told Scalia what they meant by the 4th ammendment is "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated unless the police are professionals."

Also, if Scalia does not raise 8 million dollars, Patrick Henry will kill him.

The court's five-member conservative majority, anchored by new Chief Justice John Roberts and Alito, said that police blunders should not result in "a get-out-of-jail-free card" for defendants.

"therefore, we will start legalizing the blunders post-haste"

The one thing I can say is that I cannot say anything about this - I don't have to know about it for bar exam purposes because it was decided this term.

Push out the outside world!
Pay no attention to what is going on around you!
Give over to the vaccum that is the bar exam!
