This is my photo. I have a CC lisc. on my photos for a variety of ethical reasons that are quite boring to go into here. I dont mind it being up there, there is a link and they are telling people where my flickr account is, and all that...so its cool.

but my problem is that i didnt know at all, that they were using this, and they bumped up my users, which means i get to upload less photos, and they might be making money off it.

i would have much much less problems if they emailed me and said hey dude we want to use this, yr awesome...then i would say, sure dude go ahead...

am i being an asshole, or looking a gift horse in the mouth or am i using CC different, should i be harder on use, or are they breaking ethical boundres?

No, I think you are entitled to *complain* about this. I think Adam Curry sued a magazine because they had stolen a picture from his Flickr.account. You can politely ask them to host it elsewhere. Or maybe you can host it somewhere else so they can change the link?

thats the thing, is my whole aesthetic is about the lack of authourship, why am i getting pissy about it nwo

How do you mean? (Sorry, I'm slow.) You mean, aesthetically speaking you don't think there's a thing as authorship but you still feel violated?

what type of CC licence? aren't there a few? you can specify that it must be credited to you, can't be used for commercial purposes, can't be altered, stuff like that. yours just seems to be marked as BY: which means they only have to say who it's by, which they do.

http://creativecommons.org/licenses/by/2.0/

other, stricter alternatives are here:

http://creativecommons.org/licenses/

http://creativecommons.org/licenses/by-nc-sa/2.5/ being the most popular. (must say who it's by, can't be used for commercial purposes, anything based on it must also be made available under same terms)

(the linux magazine i read had a big article about it all just this month)

Hi, I run everystockphoto.com. I sent an email to anothony earlier, but I thought I would respond here as well. This kinds of stuff comes up a lot. Many people who use CC licenses dont really know what they are doing, so we try to be friendly about it, and we always de-list on request.

A couple things to add: people who are worried about their CC license should review all the licenses, there are much more restrictive ones than the BY license, which is the only one we index from Flickr. We are serious about the licenses that the media we index are covered under.

Here are some excerpts from my email to Anthony.

>>>>
Firstly, let me explain the site. We are a search engine for license-specific media. We do not host the photos, we just provide a single place to search them, tag them if wanted, and provide links back to the host page, as well as crediting the photographer, and providing as much information about the photo as we have.

Due to the nature of the site, it is not possible to contact every photogrpher. We often add tens of thousands of photos per week.

The license that you have used on your photo does not require that we contact you to make use of the photo. Indeed, the whole purpose of releasing your photos under a CC license is to share them, under specific conditions. The license you are using, perhaps you should read, at: http://creativecommons.org/licenses/by/2.5/

It is also important to understand that the usage of this kind of license is non-revocable - that means you cant take it back. At everystockphoto.com, we still delist photos on request. But legally, anyone who has already taken the photo may use it, and distribute it, forever. http://www.everystockphoto.com/blog.php?id=10 - so people should really think before they use the licenses!
