Gonzales acknowledged that the Constitution declares "habeas corpus shall not be suspended unless ... in cases of rebellion or invasion the public safety may require it.'' But he insisted that "there is no express grant of habeas in the Constitution.''

GAH! How did this man even score high enough on an LSAT to get accepted to law school?

You Americanishes need an equivalent of Judge John Deed amirite amirite?

Bhumibol Adulyadej (Lucretia My Reflection), Wednesday, 24 January 2007 16:44 (eighteen years ago)

The court ruled only on the right to habeas corpus that was created by statute, Gonzales replied. He then asserted that the Constitution does not contain any express right of habeas corpus, only "a prohibition against taking it away.''

this is like arguing with a third grader

Shakey Mo Collier (Shakey Mo Collier), Wednesday, 24 January 2007 16:53 (eighteen years ago)

Not true, not true! they say "Creator" and "Providence", proving that the Founders wanted this to be a Christian Nation, so we should go ahead and start instituting certain Judaic laws(except the whole "jubilee" and "anti-usury" ones)!

bayeax.jpg is totally otm!! they're trying to sort of "re-royalize" habeas. it's medieval understanding, i take it, was that englishmen, while in england, were supposed to be treated in a certain way. during the colonial enlightenment, this was extended, "hey, why shouldn't everyone get this sort of treatment, all the time?" specific and local legal precendents were blown up into universal rights, coming before citizenship or circumstance (HOORAY). this is all a big headache for "freedom," somehow. oh well!
