Executive Order: Blocking Property of Certain Persons Who Threaten Stabilization Efforts in Iraq

Message to the Congress of the United States Regarding International Emergency Economic Powers Act

By the authority vested in me as President by the Constitution and the laws of the United States of America, including the International Emergency Economic Powers Act, as amended (50 U.S.C. 1701 et seq.)(IEEPA), the National Emergencies Act (50 U.S.C. 1601 et seq.)(NEA), and section 301 of title 3, United States Code,

I, GEORGE W. BUSH, President of the United States of America, find that, due to the unusual and extraordinary threat to the national security and foreign policy of the United States posed by acts of violence threatening the peace and stability of Iraq and undermining efforts to promote economic reconstruction and political reform in Iraq and to provide humanitarian assistance to the Iraqi people, it is in the interests of the United States to take additional steps with respect to the national emergency declared in Executive Order 13303 of May 22, 2003, and expanded in Executive Order 13315 of August 28, 2003, and relied upon for additional steps taken in Executive Order 13350 of July 29, 2004, and Executive Order 13364 of November 29, 2004. I hereby order:

Section 1. (a) Except to the extent provided in section 203(b)(1), (3), and (4) of IEEPA (50 U.S.C. 1702(b)(1), (3), and (4)), or in regulations, orders, directives, or licenses that may be issued pursuant to this order, and notwithstanding any contract entered into or any license or permit granted prior to the date of this order, all property and interests in property of the following persons, that are in the United States, that hereafter come within the United States, or that are or hereafter come within the possession or control of United States persons, are blocked and may not be transferred, paid, exported, withdrawn, or otherwise dealt in: any person determined by the Secretary of the Treasury, in consultation with the Secretary of State and the Secretary of Defense,

(i) to have committed, or to pose a significant risk of committing, an act or acts of violence that have the purpose or effect of:

(A) threatening the peace or stability of Iraq or the Government of Iraq; or

(B) undermining efforts to promote economic reconstruction and political reform in Iraq or to provide humanitarian assistance to the Iraqi people;

(ii) to have materially assisted, sponsored, or provided financial, material, logistical, or technical support for, or goods or services in support of, such an act or acts of violence or any person whose property and interests in property are blocked pursuant to this order; or

(iii) to be owned or controlled by, or to have acted or purported to act for or on behalf of, directly or indirectly, any person whose property and interests in property are blocked pursuant to this order.

(b) The prohibitions in subsection (a) of this section include, but are not limited to, (i) the making of any contribution or provision of funds, goods, or services by, to, or for the benefit of any person whose property and interests in property are blocked pursuant to this order, and (ii) the receipt of any contribution or provision of funds, goods, or services from any such person.

Sec. 2. (a) Any transaction by a United States person or within the United States that evades or avoids, has the purpose of evading or avoiding, or attempts to violate any of the prohibitions set forth in this order is prohibited.

(b) Any conspiracy formed to violate any of the prohibitions set forth in this order is prohibited.

Sec. 3. For purposes of this order:

(a) the term "person" means an individual or entity;

(b) the term "entity" means a partnership, association, trust, joint venture, corporation, group, subgroup, or other organization; and

(c) the term "United States person" means any United States citizen, permanent resident alien, entity organized under the laws of the United States or any jurisdiction within the United States (including foreign branches), or any person in the United States.

Sec. 4. I hereby determine that the making of donations of the type specified in section 203(b)(2) of IEEPA (50 U.S.C. 1702(b)(2)) by, to, or for the benefit of, any person whose property and interests in property are blocked pursuant to this order would seriously impair my ability to deal with the national emergency declared in Executive Order 13303 and expanded in Executive Order 13315, and I hereby prohibit such donations as provided by section 1 of this order.

Sec. 5. For those persons whose property and interests in property are blocked pursuant to this order who might have a constitutional presence in the United States, I find that, because of the ability to transfer funds or other assets instantaneously, prior notice to such persons of measures to be taken pursuant to this order would render these measures ineffectual. I therefore determine that for these measures to be effective in addressing the national emergency declared in Executive Order 13303 and expanded in Executive Order 13315, there need be no prior notice of a listing or determination made pursuant to section 1(a) of this order.

Sec. 6. The Secretary of the Treasury, in consultation with the Secretary of State and the Secretary of Defense, is hereby authorized to take such actions, including the promulgation of rules and regulations, and to employ all powers granted to the President by IEEPA as may be necessary to carry out the purposes of this order. The Secretary of the Treasury may redelegate any of these functions to other officers and agencies of the United States Government, consistent with applicable law. All agencies of the United States Government are hereby directed to take all appropriate measures within their authority to carry out the provisions of this order and, where appropriate, to advise the Secretary of the Treasury in a timely manner of the measures taken.

Sec. 7. Nothing in this order is intended to affect the continued effectiveness of any rules, regulations, orders, licenses, or other forms of administrative action issued, taken, or continued in effect heretofore or hereafter under 31 C.F.R. chapter V, except as expressly terminated, modified, or suspended by or pursuant to this order.

Sec. 8. This order is not intended to, and does not, create any right, benefit, or privilege, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, instrumentalities, or entities, its officers or employees, or any other person.

Also, please Google-proof and anonymize if possible. I need my cattle.

dean ge, Monday, 23 July 2007 15:21 (eighteen years ago)

It specifies "acts of violence," so I wouldn't expect to find your bank account frozen tomorrow for posting to message boards.

Nonetheless, part of a disturbing trend of increasing executive power.

Hurting 2, Monday, 23 July 2007 15:24 (eighteen years ago)

If there's anything I learned growing up with One To Grow On, it's that verbal abuse hurts as much as a fist. Surely, they could find a way to string me up for psychological violence which threatens to impair his ability to stabilize efforts to enslave the universe?

dean ge, Monday, 23 July 2007 16:31 (eighteen years ago)

"any person whose property and interests in property are blocked pursuant to this order"

=

?

Tracer Hand, Monday, 23 July 2007 16:54 (eighteen years ago)

This is what gets me:

or to pose a significant risk of committing

As to determined by some guy in a backroom somewhere who will never be held accountable.

dean ge, Monday, 23 July 2007 17:42 (eighteen years ago)

as to be...

dean ge, Monday, 23 July 2007 17:43 (eighteen years ago)

nicely leaves out the justice department completely, so all authorities given jurisdiction to apply this don't have to show up in front of a judge until AFTER fucking over some poor schmuck

El Tomboto, Monday, 23 July 2007 18:00 (eighteen years ago)

The paranoid nutters who said "first it's the people with the funny foreign names, next come the Smiths and Joneses" may be correct afterall. I seriously hope the powers this presidency has claimed are not just continued from this point on, claimed by every president hereafter. Because, then I think it would only be a matter of time until the paranoid nutters didn't look so paranoid afterall.

dean ge, Monday, 23 July 2007 18:10 (eighteen years ago)

As to determined by some guy in a backroom somewhere who will never be held accountable.

Not that this makes it cool and all, but it does say "as determined by the Secretary of the Treasury, in consultation with the Secretary of State and the Secretary of Defense."

Kerm, Monday, 23 July 2007 19:35 (eighteen years ago)

Oh, I just figured that meant those are the 3 guys who officially get pardoned if any hoopla should ensue due to excessive carelessness on the part of the people who actually come and destroy your life.

dean ge, Monday, 23 July 2007 19:49 (eighteen years ago)

This sounds like a job for... The A-Team!

Kerm, Monday, 23 July 2007 20:01 (eighteen years ago)

is there any expert analysis of this out there?

Tracer Hand, Tuesday, 24 July 2007 11:02 (eighteen years ago)

Only a couple, the rest have been arrested before they even started typing, probably.

The bit in that first piece about "criminalizing the antiwar movement" is a bit off base. First of all, I don't see how the language of the order could be interpreted that way, and second, given the ineffectualness of the anti-war movement, I doubt Bush is giving them much thought (unless you want to call the majority of America, who opposes the war, the anti-war movement).

Hurting 2, Tuesday, 24 July 2007 13:06 (eighteen years ago)

OTM - it's paranoia and martyrdom-wish fulfillment. You'd expect a professor to at least know what objectivity is. Here's he is just lazily pushing the "see, They Evil and We Good" agenda all over again.

It's still not right, that order, but this preaching to the converted-type article isn't going anywhere either.

StanM, Tuesday, 24 July 2007 13:13 (eighteen years ago)

So now, George Bush apparently said over the weekend (I think that's what I heard on the radio) that he "may" have to use the 22nd amendment loophole and remain in power for a third term because of this terrorism situation. Are we concerned yet?

dean ge, Thursday, 26 July 2007 14:00 (eighteen years ago)

link? he always made it sound like he had no interest sticking around to deal with his mess.

The Cursed Return of the Dastardly Thermo Thinwall, Thursday, 26 July 2007 15:04 (eighteen years ago)

WTF? There is no "22nd Amendment loophole."

Phil D., Thursday, 26 July 2007 15:08 (eighteen years ago)

22nd Amendment loophole = it says you cannot be elected president after two terms, not that you cannot serve as president after two terms. He could still run for VP and ascend to the presidency (but really that's not gonna fucking happen, nobody's going to vote for a ticket with GWB as veep)

Curt1s Stephens, Thursday, 26 July 2007 15:10 (eighteen years ago)

Was this AM radio you think you heard this on, dean?

Kerm, Thursday, 26 July 2007 15:12 (eighteen years ago)

Sorry, I heard it on the radio (and not too clearly), so I don't have a link to offer. I briefly tried to Google it, but the people on the radio were saying it hadn't hit the media (yet the radio is the media, no?). All I found were pages from 2005 and 2006 speculating. It would help if I knew where he was speaking last weekend.

dean ge, Thursday, 26 July 2007 15:13 (eighteen years ago)

(but really that's not gonna fucking happen, nobody's going to vote for a ticket with GWB as veep)

After a weekend stuck with people who watched Fox News religiously, lets not underestimate the willful ignorance of middle America.

jon /via/ chi 2.0, Thursday, 26 July 2007 15:14 (eighteen years ago)

yep, npr

dean ge, Thursday, 26 July 2007 15:15 (eighteen years ago)

NPR what? What city? What show?

Hurting 2, Thursday, 26 July 2007 15:29 (eighteen years ago)

If I am the only one disseminating this info, I say we forget all about it because I don't know what I heard exactly. I can't find anything online except an old April Fool's joke and I don't usually listen to npr, so I have no idea what show I was listening to.

I just asked the woman who had it on the radio and she can't tell me anything. I assumed it was npr, but she just told me it could be anyone because she listens to so many AM stations. And anytime I talk politics with her she starts rambling (always has an earpiece in one ear, btw), which is why I have just disappeared from this thread for a half hour!

dean ge, Thursday, 26 July 2007 15:45 (eighteen years ago)

22nd Amendment loophole = it says you cannot be elected president after two terms, not that you cannot serve as president after two terms. He could still run for VP and ascend to the presidency

Um, this is very much an open question, and in combination with the 12th Amendment, which says that no person who is not able to serve as President may serve as VP, would seem to indicate that this is not a possibility. And I don't think even this Supreme Court would be craven enough to find otherwise in the ensuing chaos.

What's more, the Constitution specifically provides for an election every four years, which is far more important than any supposed loophole; and there is no Constitutional provision that I know of for suspending or canceling an election, war or no war. Dude would have to declare martial law or something, and good luck w/that.

Phil D., Thursday, 26 July 2007 15:47 (eighteen years ago)

BTW, WNYC (NY NPR) sometimes airs a really awful comedy show with some satirical news bits, so it could have been that.
