to be insensitive or not to be insensitive, that is the question

Gukbe, Tuesday, 11 December 2007 06:01 (seventeen years ago)

Yes, this is fucked.

W4LTER, Tuesday, 11 December 2007 06:03 (seventeen years ago)

sadly, we can hardly be surprised by this.

J0rdan S., Tuesday, 11 December 2007 06:04 (seventeen years ago)

No, but this is still incredibly fucked up.

Trayce, Tuesday, 11 December 2007 06:05 (seventeen years ago)

and here i thought the softening of jail sentences for crack and the conviction of michael vick was leaving me with a positive new day for the US.

Or rather: Also, NJ abolished the death penalty.

Hurting 2, Tuesday, 11 December 2007 06:20 (seventeen years ago)

So, I have a new hobby.

Any moment I get tired from writing, I'll just send another email to Chuck Schumer and any other rep I should fancy.

It'll do nothing, but

i, grey, Tuesday, 11 December 2007 06:35 (seventeen years ago)

Oh well, at least Blackwater is finally under control

hopefully some of her rapists or the supervisors who imprisoned her have been blown into hundreds of pieces or possibly kidnapped and beheaded.

El Tomboto, Tuesday, 11 December 2007 07:21 (seventeen years ago)

"Toutube"

Hurting 2, Tuesday, 11 December 2007 07:21 (seventeen years ago)

getting gang-raped by your own coworkers would be one of the few cases where I'm going to have sympathy for any green zone contractor - the rest of them can quite honestly eat shit and die.

El Tomboto, Tuesday, 11 December 2007 07:22 (seventeen years ago)

what makes this even worse is the realization that this is also happening to iraqi women who wont be "lucky" enough to have their stories heard or experience even the remotest sense of justice

max, Tuesday, 11 December 2007 07:27 (seventeen years ago)

or anybody really who isn't white, female, and strong enough to ask for help and talk to the media instead of just killing themselves.

El Tomboto, Tuesday, 11 December 2007 07:31 (seventeen years ago)

the rape kit disappeared after it was handed over to KBR security officers.

'Certainly I'll just take this vital evidence of our wrongdoing and keep it in a safe place for you...'

Ned Trifle II, Tuesday, 11 December 2007 07:33 (seventeen years ago)

Lucky this kind of thing is just an isolated incident...

Ned Trifle II, Tuesday, 11 December 2007 07:35 (seventeen years ago)

that makes no sense at all. it almost seems like the Army is committing obstruction of justice by doing that, but like the article says, everybody over there is above the law.

El Tomboto, Tuesday, 11 December 2007 07:36 (seventeen years ago)

xpost re: handing over the rape kit

El Tomboto, Tuesday, 11 December 2007 07:36 (seventeen years ago)

the audacity is so appalling.

J0rdan S., Tuesday, 11 December 2007 07:39 (seventeen years ago)

this just makes my skin crawl

latebloomer, Tuesday, 11 December 2007 07:55 (seventeen years ago)

the rape kit disappeared after it was handed over to KBR security officers.

I don't understand this bit: why would the army hand over the evidence to the company whose actions they're investigating?

Tuomas, Tuesday, 11 December 2007 08:11 (seventeen years ago)

you're not american are you?

tipsy mothra, Tuesday, 11 December 2007 08:14 (seventeen years ago)

Though I'm not even sure what exactly is a "rape kit"...

J0rdan S., Tuesday, 11 December 2007 08:16 (seventeen years ago)

tuomas, a rape kit is a procedure that is done to a woman who thinks she may have been raped. it's meant to examen the vagina to see if there are obvious signs of rape and to collect semen, hairs, etc. for the purposes of evidence. it usually happens right after the rape is reported so the evidence is preserved.

J0rdan S., Tuesday, 11 December 2007 08:20 (seventeen years ago)

so basically it seems as if this woman has no DNA evidence to support her case.

J0rdan S., Tuesday, 11 December 2007 08:21 (seventeen years ago)

Okay, so why did they hand the kit over to the guy representing the alleged rapists? That makes no sense to me.

Tuomas, Tuesday, 11 December 2007 08:22 (seventeen years ago)

because the army has no interest in prosecuting blackwater employees.

J0rdan S., Tuesday, 11 December 2007 08:24 (seventeen years ago)

meaning it wasn't an accidental disappearance.

J0rdan S., Tuesday, 11 December 2007 08:24 (seventeen years ago)

Brian Ross and the Investigative Team

god bless tv news. i really don't doubt it's true, but the article doesn't really help you know?

strgn, Tuesday, 11 December 2007 08:27 (seventeen years ago)

this isn't about blackwater and regardless of the Army's interest, there are legal issues that prevent criminal investigations from taking place as they normally would. Army CID wouldn't have jurisdiction.

El Tomboto, Tuesday, 11 December 2007 08:27 (seventeen years ago)

i meant haliburton, but thx for the clarification anyway.

J0rdan S., Tuesday, 11 December 2007 08:28 (seventeen years ago)

that was just a complaint about tv news honest, gangraping really does happen but you know the article hit so many audience targets that i'm not surprised you dudes are chatting so vehemently about it now

strgn, Tuesday, 11 December 2007 08:30 (seventeen years ago)

KBR has moved for Jones' claim to be heard in private arbitration, instead of a public courtroom. It says her employment contract requires it.

and I'm assuming the only reason they can say this and have it hold an ounce is because once again the jurisdictional issues are muddy as hell. Clearly State and the US Attorneys aren't interested in going after KBR, although as mentioned, since Army CID wasn't able to hold the rape kit, the necessary evidence to prosecute isn't there, plus, since when is sexual assault a federal crime? Maybe kidnapping? I don't know.

El Tomboto, Tuesday, 11 December 2007 08:31 (seventeen years ago)

as tomboto mentioned before, these dudes getting blasted in iraq would be the only true justice.

J0rdan S., Tuesday, 11 December 2007 08:33 (seventeen years ago)

exactly how many decades is the legislative branch going to wait before they try to make some laws governing private contractors, private armies, whatever, and their behavior outside of the US? yeah, i know they'd be vetoed, but at least start making a bloody effort.

GOTT PUNCH II HAWKWINDZ, Tuesday, 11 December 2007 08:52 (seventeen years ago)

not as big of an issue as bringing the whole mess to a halt by bringing the troops back home, though, really. And they can't get that done either. They can't even limit the funding.

El Tomboto, Tuesday, 11 December 2007 08:58 (seventeen years ago)

disgusting:

El Tomboto, Tuesday, 11 December 2007 09:04 (seventeen years ago)

It was only a matter of time^^^

The kind of story the Left can rally around. The kind of story we aren't allowed to question...

FFS. Of course you can question it. Let's have the thing in court so that it can be questioned, I think that's all she's asking for right?

Ned Trifle II, Tuesday, 11 December 2007 09:45 (seventeen years ago)

The journal entry on her website dated "May 4, 2007" says the rape kit was found, but the doctor's notes and photographs of her bruises are still missing. And then there's: May 31, 2007- Lynn Falanga called me to tell me that the AUSA took on my case as an “intake” so that they could investigate my case diligently. In regards to the missing pictures and doctor's notes that were taken in Baghdad Lynn Falanga and I both called the doctor that performed the rape kit. The doctor stated to both of us that “I have no idea which rape victum you are because so many young contractor girls were raped after drinking with the guys” she also stated that “I performed so many rape kits in the six months that I was stationed there that there would be no way to recall whom yours was."

Also, I don't know why but the dates of her journal entries are totally screwed up... jumping from 2005 to 2007 back to 2005 and then back again to 2007... there's a section where the 2005 is obviously supposed to be 2006, but there's still a discontinuity or missing year in there.
