On the Fourth of July, a Fourth Amendment Question

So, the Fourth Amendment to the Constitution of the United States of America protects against unlawful searches and seizures by the government.

One of the areas that this protection applies to is automobiles.

So, if you were driving a bunch of your friends around one night, would you want to know - lets say to start simply for the sake of knowing - if someone had something illegal on them, like drugs, weapons or other illegal items or substances?

How about if you were simply riding in the car with someone who was riding dirty?

I am curious as to see what most folks' preventative measures are.

ESPECIALLY if it was a concealed weapon. fuck things can get out of control really really quickly. i'd want to know as much as possible.

I've never hung with people stupid enough to carry concealed weapons.

when i worked in a warehouse there were a few who carried knives, i usually just found a box cutter when i needed to cut something.

it doesn't really matter anyway, all a cop has to do is say he smelled marijuana and that gives him probable cause to search your car. if there's nothing there he can just plant some to cover his ass.

The Renquist Court provides an answer.

the court may not convict you but a cop will still arrest you.

So, apparently you can always be arrested for sitting in a vehicle that contains cocaine. But you need a really bad lawyer to be convicted for it.

Exactly. BUT - I would like to avoid being arrested, period.

SO - ask if anyone's holding, I would say.
