Even stupider is the story linked in the bottom of the article, where two teenagers who shot pictures of themselves having sex were prosecuted for producing child pornography even though they never showed the pictures to anyone else! They tried to appeal, but...
By a 2-1 vote, the appeals court didn't buy it. Judge James Wolf, a former prosecutor, wrote the majority opinion.
Wolf speculated that Amber and Jeremy could have ended up selling the photos to child pornographers ("one motive for revealing the photos is profit") or showing the images to their friends. He claimed that Amber had neither the "foresight or maturity" to make a reasonable estimation of the risks on her own. And he said that transferring the images from a digital camera to a PC created innumerable problems: "The two computers (can) be hacked."

When I was 18, I started dating a girl who was 15 at the time. The official age of consent in Finland is 16, but the law does say that if the age difference between a couple is "reasonably small", the older party shouldn't be prosecuted for having sex with someone under 16. I don't know how strict the Finnish law is with child pornography, but according to the above logic I might've been prosecuted for taking nude photos of her even though it was legal to have sex with her.

Tuomas, I understand your general point here, but this isn't the grand logical paradox you're suggesting it is -- there are plenty of things in the world that are legal to do but not to document (and a few arguments could be made that taking nude photos is actually a more significant thing, requiring more judgment, than sleeping with someone)

As I recall, the clinching argument for treating the mere possession of child pornography as a crime, rather than as a victimless activity, was that in order to create the images, some child would have to be victimized and sexually exploited, and because such images are quite often purchased, the mere possessor of such images was aiding and abetting this victimization.
This argument falls into soggy shreds when the creator of the image is also the purported victim, the exchange of the image involved no money or other considerations, and no adults entered the transaction.
Which is not to say that the image, if it were to circulate, could not have eventually been sold by scummy adults who could profit by its existance, but prosecuting the child who took the picture is about as absurd as you can get.

A kid in my high school got prosecuted for selling a hit of acid to 2 girls. He was 16, they were 15. Therefore, he was busted as a "pusher" who was distributing a controlled substance "to minors". Repercussions were even higher because said action was within one mile of school grounds.

I don't think they are less at risk, really (and also sadly). Because parents are more protective, pedos probably revert to other strategies. (Have their own kids more than say in the past, internet as a means to lure kids and swap porn,...) But less? Sadly I don't think so. :-( Then again it's very hard to compare really as in the past they didn't report this as much and as a result you can't compare stats or whatever.
