I prefer "The Batman" as it reflects a more distanced relationship or even familiarity with him. If he/it's some shadowy aspect of your life as an average Gothamite beating up thugs who circulate amongst the darker edges of your city, referring to him as "The Batman" adds just a shade more to the impact and perhaps even animality or even non-humanity of him.
"Batman" is just some dude in a cape; "The Batman" is much more a force of nature, something humanoid but possessing traits far beyond mortal men.
