Anybody know any good music that's unavailable due to licensing restrictions or court cases or sample clearances or anything? I'm thinking of making a mixtape of illegal music, but I need more songs. This is what I have so far:

the original version of "Make it Happen" by Electronic (terrible title, but actually a good song) featured some samples of Ice T, but they weren't allowed to use them. which is too bad, because while it's still a good song, the original version's better.

That's a great site that autovac linked to; hadn't seen that one before. I was gonna suggest the JAMs 1987 lp but it's mentioned there. I love that story about Mike D and AC/DC. "They just couldn't get with the sample concept"

How come nobody thinks Wire is uncool for wanting to sue Elastica? Or do people?

well, they did have something come out of that lawsuit---there was an out-of-court settlement that Elastica ended up giving Wire, wasn't there?

at least they got to keep the song on. "Connection" is still pretty great, despite any strong resemblance it may have to "Three Girl Rhumba."

How many of these lawsuits are promulgated by the artist?

Often it's the publishers who'll be pushing for a slice of the pie. I think this happened to Elastica too with Waking up, with the Strangler's publishers going after them. The band themselves weren't particularly bothered, and I may be wrong but I think it's the same re U2/Negativland. Or maybe it McGuiness's dread hand at work.

did anything actually come of the Stranglers' thing, though? i mean, it's pretty obvious, the connection (pun not intentional), but i didn't hear much about any legal (re)action regarding it, unlike with the Wire thing.

and yeah, it does seem to be more about publishing companies.

though i don't think that was the case with John Denver + New Order, but that's an entirely different matter. :)

I don't know, I just thought it was kind of lame. "Three Girl Rhumba" is only two chords! Is it impossible to concieve of two chords accidentally being used in a similar rhythm pattern 16 years apart, considering how many millions (literally) of people with guitars futz around for riffs? And everything else about the song is completely different!

But then, Elastica settled so I guess it was been intentional. But still. I mean, Monster Magnet stole whole arrangements from Cactus and Captain Beyond, and they didn't sue. I bet those dudes need the money these days more than Wire!

My immediate reaction to the Elastica song was that it was a rip off of Three Girl Rhumba, but I can't really remember if the Elastica/Wire comparisons I've heard came before or after that, so they might have influenced me a bit. If lots more high-profile-ish people had used that chord sequence between the two songs' release nobody'd have likely batted an eyelid.
