In Bez's autobio he mentions that in the early days they tried to get on Factory by stealing the address book from a health club, looking up Peter Hook's address,and then going round to his house and forcing a demo tape on him. He told them to fuck off, but a while later they heard the intro to a New Order song which copied one of their beats note for note. And this was later confirmed at a party by Steve himself. I assume it'd be in the early to mid 80's when this happened. Is there anyone with a good knowledge of both bands discographies who knows what I'm talking about?

my guess is it would be one of the tracks off the forty five ep (delightful/this feeling/oasis), though listening to those three just now don't particularly make me think of any NO beats..

UNfortately there is no copyrights on just drum patterns, probably due to the nature of the instrument.. You might have a case, same pattern, same machine, same tones, recorded the same way, but drums get the shaft on this, acoustic or electronic, programmed or not

Yeah its got to be "Delightful". I'd never heard the Forty Five EP before, I like it a lot more than the first album. And Sean, I'm pretty sure Ronnie (I think thats his name) was happy enough to get the compliment from New Order; according to Bez, they worshipped them, the Velvets, and Zappa (!) in the early days. And if copyright extended to drums, just think of the backlog of "Funky Drummer" cases! Tho, Clyde Stubblefield really should have enough to live comfortably, and if he isn't thats a travesty.

FYI New Order first performed "Age of Consent" in August 1982. It is not inconceivable that the Mondays would have included "Delightful" on a demo tape prior to that. I can't think of what other Mondays song it would be, but then I'm only really familiar with the first two EPs (all downhill after that etc.).
