Marvel is suing creators of City of Heroes.

Don't know how many of you play City of Heroes but the people around me are rabid avid fans. Marvel is suing NCSoft and Cryptic Studios (creators of City of Heroes). "Marvel argues that the game's character creation engine easily allows players to design characters that are virtual copies of its own superheros, including 'The Incredible Hulk'. Marvel seeks unspecified damages and an injunction against the two companies to stop using its characters." There are quite a few people suspicious that this is nothing but an effort by Marvel to undermine Cryptic Studios' successful game to prepare for the launch of their own comic book based MMORPG (Massive Mutiplayer Online Role Playing Game)."

Wired has an article about it as well. "Asking City of Heroes to police their users to ensure that they don't replicate Marvel characters is like asking a school to police its students to make sure none of them show up for Halloween in a homemade Spider-Man costume," said Cory Doctorow, a renowned writer and advocate for free speech and fair use. "It's unreasonable bullying, and it is bad corporate citizenship."

After I told my neighbor about this, he said Marvel can "suck his cock," which is how most people feel about this, I think. But he also said that the game "is like crack cocaine" to him, so....

I only wonder: What the fuck? Are their pockets not full of enough cash already?

Cory's analogy is pretty much on the money -- this is really silly, and Marvel's lawyers are going to have to bend over backwards. This would have had a better chance fifteen years ago, when the court understood less about computers, but chances are the judge's kid plays Everquest and he's gonna be all "why isn't the Tolkien estate suing them for letting people look like Aragorn?"

That said, I assume this will be settled out of court -- COH can't afford to lose the case and set a precedent that would make it easier for DC and all the piddling little publishers to sue them, and even if Marvel won they'd run into the problem of actually demonstrating damages and justifying whatever ridiculous figure they'd be asking for.
