An Old Oil Spill Divides a Brooklyn Neighborhood

For most of her life, Carol O'Neill has known the 55-acre oil spill lurking beneath the ground in the Brooklyn neighborhood of Greenpoint as a familiar smell, a sludgy tang redolent of gasoline and metal.

"When I was a kid, we knew that when you came back from Long Island for the summer, that's how you knew you were home," said Ms. O'Neill, 43, who lives in a row house on Morgan Avenue, not far from where she grew up.

The spill, the result of a 1950 tank explosion that the Coast Guard estimated leaked 17 million gallons of oil and gasoline into the ground, has been a constant presence, the suspected cause of everything from the oddly persistent stains on Ms. O'Neill's patio furniture to the weird, metallic taste of her neighbor's tomatoes. "We always thought it was something that was just underground," she said.

But a lawsuit that some residents filed on Oct. 21 against three oil companies, charging that toxic fumes from the underground spill may be endangering the health and property of those who live nearby, has left Ms. O'Neill and her neighbors feeling unsettled. Based on soil tests performed by the environmental group Riverkeeper over the summer, the plaintiffs allege that the fumes contain levels of benzene and toluene that have been associated with elevated risks for cancer. The contaminants might be seeping into as many as 100 homes directly above the spill, including Ms. O'Neill's, and affecting neighboring areas.

Greenpoint is a tight-knit community; many of the residents near the spill were born and raised there, and few want to leave. But now Ms. O'Neill and her neighbors worry about their health, and trade stories of friends and family members who have had cancer and other diseases. Some residents are also skeptical of the lawsuit itself, fearing it will do little good and may bring down property values.

Ms. O'Neill, who is considering joining the lawsuit as a plaintiff, said she was worried about the spill's effect on residents' health. "To hear that it could be causing illness, that's disturbing," she said, adding. "I know 10 people off the top of my head who died of cancer."

About two dozen residents are plaintiffs in the lawsuit, which seeks compensation from Exxon Mobil Corporation, BP and the Chevron Corporation for property damage and medical monitoring for those whose homes lie over the spill.

"I'm very worried about the health effects. That's probably what really woke me up," said Adam Pedota, 30, a plaintiff in the case who lives in the same house where he grew up, on Hausman Street. "A lot of people are nervous," he added. "Because in the last couple of years, we've had a couple of cancer cases here."

The case is being handled by Girardi & Keese, the law firm that became famous in a 1995 lawsuit against Pacific Gas & Electric; Erin Brockovich, who was a legal assistant on that case, is consulting with the firm for the Greenpoint lawsuit. Representatives of the firm, along with Justin Bloom, a former Riverkeeper lawyer who is now in private practice, met with about 100 Greenpoint residents last week, and a Girardi & Keese spokesman said that about half the current plaintiffs joined the lawsuit soon afterward.

A separate lawsuit was filed last year against Exxon Mobil by Riverkeeper, for violation of the federal environmental laws, and City Councilmen David Yassky of Brooklyn and Eric Gioia of Queens, who represent the communities along Newtown Creek, expect to join it. But Mr. Gioia said last week said he wanted more exploratory holes drilled on the Queens side of Newtown Creek to help determine if more homeowners should seek legal action.

"The toxins from this spill have had a half-century to seep under the creek, degrade our waterways, and ruin our land," Mr. Gioia said. "We need to do everything possible to ensure our residents are safe and sound from this looming environmental threat."

Brian Dunphy, a spokesman for Exxon Mobil, said in a statement that company officials are "disappointed in the legal actions that have been initiated against our remediation activities at our former Brooklyn refinery and terminal site. We believe the assertions made by Riverkeeper and others are unfounded."

Mr. Dunphy also said the company does not believe there are any "health or safety impacts" resulting from the spill, which the company believes is far enough underground that local residents and businesses are not affected.

Many Greenpoint residents, however, have mixed feelings about the lawsuits.

Some say they have little faith that yet more legal action - Exxon Mobil has been under a self-initiated consent order with the state Department of Environmental Conservation since 1990 - will have any effect, and state and local agencies have not intervened in the matter so far. Some are skeptical of the California-based Girardi & Keese, noting that the law firm is not local and questioning its motives. And others are concerned that the new lawsuit and its attendant publicity will sink home prices that have been rising rapidly during the last few years.

"I'm not convinced that it's the right thing to do," said Helen Wus, who lives over the spill but says she will not join the lawsuit. "What's going to happen, inevitably, is it's going to devalue our property. If I knew 20 years ago when I bought this house that there was so much oil under this house, I would not have bought it."

Not all Greenpoint residents are worried, however. Adam LaTempa, who lives on Apollo Street, said he was not aware of the lawsuit and did not think his neighbors were preoccupied with Riverkeeper's findings.

"Everything we've been through here, this isn't going to kill us," he said.

"People are more worried about traffic on the B.Q.E. than an oil spill."
