JUST WONDERING IF ANYBODY HAS RAN INTO THE BUSINESS END OF A CAR DOOR (IVE HAD CLOSE CALLS)...ALSO WONDERING IF THIS HAPPENS, CAN YOU SUE? (CUTTY??) WHO IS RESPONSIBLE? WHAT KIND OF PAY OFF IS THERE?

― cutty, Tuesday, 6 November 2007 18:03 (seventeen years ago)
uh, that's not going to happen
and of course you can sue, it's negligence for sure!
― cutty, Tuesday, 6 November 2007 18:04 (seventeen years ago)
however, a smart PI defense attorney would know to look into whether the bike had brakes or not--this would be contributory negligence on your part and wouldn't help your case at all...
― cutty, Tuesday, 6 November 2007 18:05 (seventeen years ago)
THAT COVER RULES! IT SHD BE CALLED, BIKES AND BREAK DANCING!!
HMMM, BRAKES, EH......HMMMMM.
CAN I SUE LEDGE FOR BAD CAPSLOCK ZINGER?????
― ddb, Tuesday, 6 November 2007 18:07 (seventeen years ago)
yes, intentional infliction of bad zinger
― cutty, Tuesday, 6 November 2007 18:18 (seventeen years ago)
personally if i ever got into an accident whilst riding my track bike i would put brakes on it right away, just in case.
― cutty, Tuesday, 6 November 2007 18:19 (seventeen years ago)
im suing for unintentional infliction of bad zinger iltrmb=zone of danger
― Hunt3r, Tuesday, 6 November 2007 18:42 (seventeen years ago)

― cutty, Tuesday, 6 November 2007 18:53 (seventeen years ago)
i yam and im doing some pi right now. well, obv not RIGHT now. im not billing it either.
― Hunt3r, Tuesday, 6 November 2007 19:03 (seventeen years ago)
i know that in SF there are lawyers that have argued that skid stop/drivetrain-counterforce on track bikes is essentially = "rear brake".
― Steve Shasta, Tuesday, 6 November 2007 20:09 (seventeen years ago)
but to original query, never been doored, knock on wood.
i was doored once (going slow, no injury) in the middle of san gennaro in little italy and then almost got in a fight w/door opening guy which was v out of character for me - luckily there were 1m cops everywhere to stop us.
― jhøshea, Tuesday, 6 November 2007 20:14 (seventeen years ago)
i think that was in oregon, shasta, and the lawyer lost. unless there have been multiple cases which is very possible. but what i'm saying is not even make the brake-less thing an issue by installing a brake as soon as there is an accident.
OR--carry a brake lever in your messenger bag and throw it on the ground claiming it fell off the bike in all the hubbub.
― cutty, Tuesday, 6 November 2007 21:30 (seventeen years ago)
years ago i made an aesthetic decision to remove my brakes from my car and control my speed by downshifting. it works pretty reliably, and if i ever hurt anyone by mistke i plan to evade responsibility by hypnotizing the court with cool rays.

FITE
― Laurel, Tuesday, 6 November 2007 22:02 (seventeen years ago)
no fighting! i'm just giving away free legal advice. like when they tell you what to do when a cop pulls you over and you are drunk or have weed in the car.
― cutty, Tuesday, 6 November 2007 22:33 (seventeen years ago)
can't you just put a stick in yr own spokes and stop the bike that way
― El Tomboto, Tuesday, 6 November 2007 22:34 (seventeen years ago)
so in that case what do you do? xp
― jhøshea, Tuesday, 6 November 2007 22:36 (seventeen years ago)
suck on a penny, fart to cover the weed smell, pray to god

E-BRAKE ON REAR TIRE, GUYS, WIF YR FOOT
i very nearly got doored yesterday, and basically actually got t-boned while riding over one of chicago's many terrifying grated bridges.
i went apoplectic on the dude, sped ahead, waited for him to catch up, and then unloaded on him, "you nearly fucking killed me blha blah blah any idea how fucking dangerous what you just did blah blah blah" and duder, who seemed to be newly arrived in this country, replied "please stop using so much profanity!"
FUCK YOU, GUY, AND FUCK WHATEVER RELATIVE WOULD BE MOST OFFENSIVE TO MENTION AT THIS PARTICULAR JUNCTURE.
― gbx, Wednesday, 7 November 2007 00:18 (seventeen years ago)
REAR BRAKE ONLY HUNTER PLEASE READ CAREFULLY
― Steve Shasta, Wednesday, 7 November 2007 01:01 (seventeen years ago)
never been seriously doored, had a couple of close calls inc one on monday when i was riding up hampstead road towards camden, overtaking another cyclist, a car swerved across the path of both of us to the left and pulled in to the kerb but like pretty far ahead of us so no worries, then as we both passed it the driver swung the door open, other cyclist had to veer sharply to the right and so did i, luckily there wasn't any traffic in the lane to my right. think the last time it happened was as i was coming up to a red light on moorgate, i'm in the bike lane and passing a taxi immediately to my right, this dumb bint shoves the door open RIGHT INTO MY FACE. yelling at her was kind of fun, she tried yelling back but i think she was too shook up to do it properly, hopefully she never did it again.
the first incident was an ordinary car, but usually it does seem to be drivers in penis-cars and passengers in taxis who are guilty of this.

but like what are they thinking? or not thinking? i remember having it drummed into me really really hard when i was very small, like 5 or something, that you always, always, always check there's nothing coming before you open a car door.
― emsk, Wednesday, 7 November 2007 10:25 (seventeen years ago)
This one? http://bikeportland.org/2006/07/28/judge-finds-fault-with-fixies/
― caek, Wednesday, 7 November 2007 10:54 (seventeen years ago)
Gotta go with the judge on that.
― Mark C, Wednesday, 7 November 2007 16:30 (seventeen years ago)
yeah, “What would you do if your chain broke?” is a key q.
I always try and cycle > 1 car door away from cars. Can be problematic on busy roads obv.
― ledge, Wednesday, 7 November 2007 17:03 (seventeen years ago)
I guess, but that's a mechanical malfunction. According to the law, a SS bike with a front brake is perfecty acceptable. If something went wrong with the brake, the rider wouldn't be able to stop either.
― Super Cub, Wednesday, 7 November 2007 17:28 (seventeen years ago)
no reason a FG w/front brake should be illegal. like, at all.
― gbx, Wednesday, 7 November 2007 17:29 (seventeen years ago)
the crappy brakes on 75% of all hand/rimbrake bikes are insufficient for the avg barnie to skid a bike, i'd bet. yknow, since im making shit up.
― Hunt3r, Wednesday, 7 November 2007 17:57 (seventeen years ago)
i don't know how they do stat construction in OR but if you offer a performance metric and not mechanical specs or functional description, and you meet the metric, id expect the metric to control. think thats bs man.
― Hunt3r, Wednesday, 7 November 2007 18:00 (seventeen years ago)
Yeah, I understand what the judge is saying, a brake is a brake. FG bikes without a brake don't have a brake. The problem is with the wording of the law. It ought to say that all bikes need to have a braking mechanism independent of the drivetrain. That would solve that problem.
― Super Cub, Wednesday, 7 November 2007 20:53 (seventeen years ago)
Can I ask something? What is the appeal of fixed or SS with COASTER BRAKES? I have seen more than a few. It seems weird.
― Laurel, Wednesday, 7 November 2007 21:35 (seventeen years ago)
The problem is with the wording of the law.
welcome to the law

did the doorer show due concern and beg for your forgiveness?
― Super Cub, Saturday, 29 March 2008 03:54 (seventeen years ago)
haha. he just looked at me like "wuh..." but he didn't really have time to say much bc i just yelled at him, shoved the door back at him and rode off.

seriously! it has the worst drivers in all of london, at least all the areas i've ridden my bike around. it's weird how you get little pockets of behaviour - for some reason people driving suvs, jeeps and whatnot in hackney are super-polite and pretty much always slow down and let me/other cyclists/pedestrians go first even if legally they don't have to. in brixton this is the opposite. but everyone in mayfair behaves like they are the only person on the road.
― emsk, Saturday, 29 March 2008 09:29 (seventeen years ago)
I notice differences day-to-day in the same area. One day drivers will seem really aware and polite. Another day they'll be driving like aggressive pricks. I have a theory that it depends on the day of the week and the day of the month. Perhaps stress related. It could also just be the luck of the draw in terms of what kind of drivers I happen to encounter.
― Super Cub, Saturday, 29 March 2008 20:23 (seventeen years ago)
the weather definitely makes a difference, and sometimes there's just a weird vibe out there. but seriously. mayfair. full of twats.

saw a guy get doored nastily in camden the other night - this car was stopped on kentish town rd outside the halfway house - ie just past the crossing after the big junction. the car had been there a while, hadn't just stopped. cyclist comes through the junction, not going that fast but not slow either and all got up with lights and yellow clothes and whatnot, when the driver of the car swung his door open and the cyclist went straight into the door - he and his bike went skidding across the road, luckily there were no moving cars beside or immediately behind him, he jumped up pretty much immediately and his bike seemed ok too, but the door of the car was totally fux0red, this guy was trying to close it for ages and it just wouldn't shut. HAHAHA. hope it cost him more than he can afford to fix it.
