Disney hates kids

Did anyone just hear that Marketplace story about Disney cracking down on the LA pinata craftsmen for trademark infringement? Fuck Disney. Can't they just say that it's a parody of the character? How does that work? Fuck Disney.

(I know the Taz Devil is WB, but the story was mostly talking about Shrek pinatas.)

Shrek is Dreamworks, not Disney.

Leon C. (Ex Leon), Thursday, 4 August 2005 22:36 (twenty years ago)

Nevertheless, why would Disney have any problem with children using sticks to whack the shit out of bootlegged versions of their characters? Who doesn't want to cut Mickey open and eat his sugary entrails?

Pleasant Plains /// (Pleasant Plains ///), Thursday, 4 August 2005 23:00 (twenty years ago)

Kill all multi-media mega studios and let God sort 'em out.

andy --, Thursday, 4 August 2005 23:01 (twenty years ago)

andy, you suck at disney!

mark p (Mark P), Thursday, 4 August 2005 23:02 (twenty years ago)

If they filled them with bleach, I think the popularity would wane.

andy --, Thursday, 4 August 2005 23:07 (twenty years ago)

Yeah, I just heard that. It was really depressing. And what's worst was the line [paraphasing] "media analcysts agree: it's in the best interests of major media corporations to protect their recognizable properties, even if that means pursuing litigation with local Mom and Pop businesses."

Remy (x Jeremy), Thursday, 4 August 2005 23:09 (twenty years ago)

Well, they guy said he would be willing to pay a license fee, but they didn't want anything to do with him. Aren't Pinatas more of a folk-art or something? Can't you sort of spoof pop culture items? Like Disney doesn't sue MAD magazine every month.

andy --, Thursday, 4 August 2005 23:12 (twenty years ago)

I remember reading something about this a few years ago: it's something ridiculous like "in situations where the artist's intent is determined to be parody or satire" the work is protected under free speech guidelines. But by attempting to replicate (f'rinstance Calvin pissing on all sorts of Chevy logos) a character in a non-parodic situation is copyrite infringement.

Remy (x Jeremy), Thursday, 4 August 2005 23:15 (twenty years ago)

what the - so artistic intent DOES matter after all?!?

thanx for clearing that up, US legal system!

Shakey Mo Collier, Thursday, 4 August 2005 23:17 (twenty years ago)

I like Calvin in the sombrero pissing on "La Migra."

andy --, Thursday, 4 August 2005 23:21 (twenty years ago)

To snip from another site:

Question: When is parody protected from a charge of trademark infringement?

Answer: Parody is a usage of a mark that pokes fun at the mark and does not confuse the public as to the source of the usage. In determining whether there is infringement the court balances the public interest in free expression against the public interest in avoiding consumer confusion. "A parody must convey two simultaneous--and contradictory messages; that it is the original, but also that it is not the original and is instead a parody. To the extent that it does only the former but not the latter, it is not only a poor parody but also vulnerable under trademark law, since the consumer will be confused."

It's funny how Tweety bird has done nothing new for 40 years but he's still beloved by Mexican novelty makers... I see Pinatas and balloons and shit all the time.

Ned Raggett (Ned), Friday, 5 August 2005 00:32 (twenty years ago)

read lawrence lessig's book on free culture for a nice history of copyright law, its evolution over time, and some nice ironic stuff about disney/ hollywood beginning as renegades of copyright, and the whole system changing in the meantime so that their copyrights are set in stone and controlled by just a few hands. yes it is a violation of copyright for a kid somewhere to draw a disney character, even if he has no intent at all to publish the image or profit from it in anyway. wtf.

carly (carly), Friday, 5 August 2005 01:11 (twenty years ago)

calvin pissing isn't satire!?

No, it's not. Calvin pissing on something out of spite is pretty in-character. The fact that he never did it on a corporate logo in the comic is kind of irrelevant. If I made a logo of Garfield eating the Fazoli's logo, I guarantee Jim Davis would be all over my ass if he stops making "high art" or whatever the fuck he's up to now.

mike h. (mike h.), Friday, 5 August 2005 01:31 (twenty years ago)

calvin praying, however, is pretty out of character. i think those decals annoy me even more than the 'pissing calvin' ones.

J.D. (Justyn Dillingham), Friday, 5 August 2005 04:03 (twenty years ago)

so a character has to be "out of character" for it to be a satire!?

Secundus Clover (s_clover), Friday, 5 August 2005 04:46 (twenty years ago)

so calvin pissing is out but calvin eating raw human flesh is in?

Secundus Clover (s_clover), Friday, 5 August 2005 04:47 (twenty years ago)

I reallyreallyreally hate all of those Calvin bumper stickers. It would make me happy if they were shown to be in violation of copyright law and thus had to be eliminated from the face of the Earth permanently.

that's intentional -- you think I have any hope of catching it on?

only if it doesn't violate any copyright laws that anal cysts might have.

Lingbertt, Friday, 5 August 2005 05:21 (twenty years ago)

How about an image of Calvin shitting on a Calvin-pissing bumpersticker sticker? I mean, that's gotta be satire, innit?

Great article about those bootleg Calvin stickers, and why Bill Watterson never licensed his characters.

Can't a pinata maker be sastified with little horses and stars and mexican boys in hats? Why'd he have to go all cheezy and make "finding nemo" rip-offs? People have no class.

I was wondering how long it'd be until someone else took a stab at that winning Hook formula. Because who doesn't enjoy seeing the dispirited, middle-aged versions of whimsical fictional kids.

i would see a melancholy live-action adaptation of house at pooh corner, populated roger-rabbit-style by shepard designs, with lots of pensive pastoral shots and a growing sense of apprehensive confusion at christopher robin's-- nah fuck it but i would definitely watch the many adventures again.

If they stay close to the original graphic novel by AA Milne and explore Tigger's grittier origin story, maybe borrowing from Frank Miller's take, than this could be good

lol fuck you disney: https://www.indiewire.com/2022/03/disney-fund-dont-say-gay-support-gay-rights-content-1234704433/

The Walt Disney Company issued a statement of support for the LGBTQ+ community amid the backlash against Florida’s “Don’t Say Gay” bill, supported by state politicians that the corporation has funded. But the company is still funding the homophobic politicians who’ve supported the bill, and nothing Disney CEO Bob Chapek has said indicates that that will change.

The Orlando Sentinel reported that Disney has given money to every single sponsor and co-sponsor of the “Don’t Say Gay” bill, which was passed by Florida’s House of Representatives February 24. Officially titled the House Bill 1557, the proposed law is heading to the state’s Republican-held Senate next.

As the Orlando Sentinel stated, the bill’s Senate sponsor, Ocala Republican Dennis Baxley, has actively backed anti-gay legislation for years, including laws that would block gay couples from adopting children.

rob, Friday, 4 March 2022 23:39 (three years ago)

Chapek may be starting to sweat a bit over this: https://www.nytimes.com/2022/03/09/business/disney-ceo-florida-lgbtq-bill.html

Mr. Chapek also said Disney would donate $5 million to L.G.T.B.Q. organizations, including the Human Rights Campaign. “As I wrote to our employees earlier this week, we’re committed to supporting community organizations like these so they are better equipped to take on these fights,” he said. “Meanwhile, we will also be assessing our approach to advocacy, including political giving in Florida.”

Unless Disney's "political giving" undergoes some serious changes, I can't be bothered to give a shit about whatever minor ducats they feel like throwing at the HRC.
