I'm Beatallica's "official" webkeeper.. if you want the latest news go to the main site:

http://www.sensoryresearch.com/~starkeff/beatallica.html

The rootthis site is out of date.

Stark Effect, Friday, 16 May 2003 07:25 (twenty-two years ago)

Stark Effect, any chance this will become exploited in a good way by the media and the masses will be able to hear (and maybe even see) Beatallica sometime soon? I would love to see them on Conan or MTV...

Scaredy Cat, Friday, 16 May 2003 15:43 (twenty-two years ago)

Can't. The band insists on remaining anonymous to stave off the wrath of Lars (and possibly the wrath of Macca.)

Lord Custos Epsilon (Lord Custos Epsilon), Friday, 16 May 2003 15:55 (twenty-two years ago)

Wow. This is so horrible!!! I love them!

Aaron W (Aaron W), Friday, 16 May 2003 17:35 (twenty-two years ago)

There was some talk of doing a video, but nothing definite has been decided. The hard part will be finding someone willing to do it for free.

Beatallica is kind of an experiment in good will-- you'll notice that there are no CD's or anything else for sale, nor are there any ads or links to commercial sites. We figure that as long as it's clear we're not making a profit, no one will come after us.

Stark Effect, Friday, 16 May 2003 21:51 (twenty-two years ago)

We figure that as long as it's clear we're not making a profit, no one will come after us.

It's not as much the "we're not making a profit" thing that lessens the chance of lawsuits as much as the "we're butt poor, so trying to sue us will get you no money and guarantee us lots of free publicity for us and against you" thing. ;)

beatallicarfukinawsom, Monday, 28 July 2003 02:16 (twenty-two years ago)

Well, it's not them, just a good impersonation. So good, in fact, that it makes people think that it's really them.

Let's all sway back in forth as we communally sing "Hey, Dude."
Its has even more of a "Kumbaya" vibe than the song they are parodying!
    Gotta love that.

Parody Band Forced Offline by Sony Publishers
    Wed Mar 2, 2005 04:51 PM ET

    By Andy Sullivan

WASHINGTON (Reuters) - They combine the classic melodies of the Beatles with the heavy-metal thunder of Metallica, but the rock band Beatallica certainly isn't music to Sony Corp.'s ears.

Sony's publishing arm, which owns the rights to the Beatles catalog, has ordered the Milwaukee band to take down its Web site and pay unspecified damages for recording songs like "Leper Madonna" and "Got to Get You Trapped Under Ice."

Beatallica says it is not ripping off Beatles songs, but parodying them in a loving tribute that is protected by copyright laws. The Web site has been taken offline while the band considers its legal options.

"I think they're being very shortsighted. The amount of income that we generate from this is minuscule. None of us are quitting our day jobs," said David Dixon, the band's "Webmaster of Puppets."

Beatallica formed in 2001 as a one-off Metallica tribute band for a local festival, but soon hit upon the idea of adapting Beatles songs to Metallica's heavy-metal format.

Dixon posted their songs online, attracting fan mail from all over the world. Dixon estimates that more than 1 million copies of the band's songs have been downloaded for free or traded through online file-sharing networks.

The band hired lawyers to make sure it did not run afoul of copyright and trademark laws.

But on February 24, Beatallica received a letter from Sony/ATV Music Publishing demanding that the band take down its Web site and pay Sony "an amount to be discussed."

"Such uses of Sony/ATV compositions without the express authorization or license has caused and continues to cause substantial and irreparable injury, and is in direct violation of Sony/ATV's rights," the letter said.

While the site remains offline, the band's songs can be easily found through offshore Web sites. Nearly 6,000 supporters have signed an online petition demanding Sony drop the case.

Dixon said the band had even created new Beatles fans.

"We've had many people who've written to the site, especially young headbangers, who have said, 'I've always hated the Beatles' music, but I think I'm going to check it out now,"' he said. "It's a bit of an outreach project crossing generations."

The legalities of parody came up during the election over the JibJab Bush-Kerry cartoon montage using Woody Gutherie’s familiar folk song "This Land" when Ludlow Music sent a cease and desist letter.

If your use is intended for your own commercial gain, it is less likely to fall under the category of fair use.

Free speech doesn’t necessarily protect all parody from copyright infringement. When “Weird Al” Yankovic parodies a popular song, he gets permission from and pays royalties to the original artist.

When METALLICA frontman James Hetfield was asked last year by Kerrang! magazine if he's ever heard BEATALLICA, he replied, "Yeah. I heard that. That was amazing. Someone put a lot of thought and talent into that man!" Asked if he was being sarcastic, he said, "No, not at all. I heard it online. It was about a year ago, or more. It was pretty amazing. It was pretty well thought out so I'm glad there's people like that in the world to do that and it's very entertaining for us, for sure!"

    >Hetfield heard the music online? Downloading?

LARS ULRICH Offers Support To BEATALLICA In Publishing Dispute - Feb. 19, 2005

    http://www.roadrunnerrecords.com/blabbermouth.net/news.aspx?mode=Article&newsitemID=33118

"Let it be known that BEATALLICA, at this moment, is NOT getting sued by anyone in METALLICA or by any living Beatle. [BEATALLICA frontman] Jaymz actually had a conversation with Lars Ulrich since the cease and desist was sent and we're happy to say that the METALLICA camp is fully behind us and the integrity of BEATALLICA. Lars was very personable and we're thankful to have his personal time with all this. Over the last few dayz, there have been bangers from all over the world writing to us or writing on blogs/sites that have had concerns, comments, and rants about what is happening or what will happen. We do appreciate each and every one of you who is on our side, really. We know who our allies are and we look forward to extending relationships with the present folks who are Beatallibangers and Beatallibangers to come in the near future. We want to address the situation with the correct parties and come to a conclusion.

"We do have a concern about the site, of course. If any of you reading this want to be on our private email list, please let us know by writing: beatallica@sbcglobal.net. You can ask to be put on the list by writing into the bulletin board and starting a new post or by contacting us via the booking mail address as well. If the site goes down, the sbcglobal address will get you to us for email sign up, booking contact, merch contact, and everything else associated with BEATALLICA.

MTV News 03.03.2005 3:13 PM EST

"Early on they talked to lawyers who told them that this was covered under the parody precedent of the 2 Live Crew case," webmaster David Dixon said, citing the infamous 1994 case in which the raunchy rap act prevailed in a suit filed by the company representing Roy Orbison over their salacious parody of his song "Oh, Pretty Woman," titled "Pretty Woman."

but it's never been clear if weird al actually has to get that permission. he's always done it as a courtesy.

fact checking cuz (fcc), Thursday, 3 March 2005 23:34 (twenty-one years ago)

I believe that the 2 Live Crew Supreme Court should have settled that as Luther Campbell asked and was refused permission to use Pretty Woman and he still won his landmark parody case.

The Copyright Act in Section 107 allows "Fair Use" and the United States Supreme Court in Campbell v. Acuff-Rose Music, Inc. (1994) stated that a parody as a form of criticism or comment could be fair use of a copyrighted work. Oh, Pretty Woman written by Roy Orbison and William Dees. Luther Campbell and 2 Live Crew, wrote Pretty Woman that had substantial similarities to the Orbison/Dees song. The Supreme Court accepted 2 Live Crew's song as a parody because the rap song mimicked the original to achieve its message.

The Court determined that the purpose and character of the use, favored 2 Live Crew because a "parody has an obvious claim to transformative value" and the rap song was certainly transformative in that " it provid[ed] social benefit, by shedding light on an earlier work, and, in the process, creat[ed] a new one."

"Official" bulletin board is currently still up - with a Cease and Desist! forum

and there is an online petition to drop the C&D.
