Beatallica is kind of an experiment in good will-- you'll notice that there are no CD's or anything else for sale, nor are there any ads or links to commercial sites. We figure that as long as it's clear we're not making a profit, no one will come after us.

It's not as much the "we're not making a profit" thing that lessens the chance of lawsuits as much as the "we're butt poor, so trying to sue us will get you no money and guarantee us lots of free publicity for us and against you" thing. ;)

WASHINGTON (Reuters) - They combine the classic melodies of the Beatles with the heavy-metal thunder of Metallica, but the rock band Beatallica certainly isn't music to Sony Corp.'s ears.
Sony's publishing arm, which owns the rights to the Beatles catalog, has ordered the Milwaukee band to take down its Web site and pay unspecified damages for recording songs like "Leper Madonna" and "Got to Get You Trapped Under Ice."
Beatallica says it is not ripping off Beatles songs, but parodying them in a loving tribute that is protected by copyright laws. The Web site has been taken offline while the band considers its legal options.
"I think they're being very shortsighted. The amount of income that we generate from this is minuscule. None of us are quitting our day jobs," said David Dixon, the band's "Webmaster of Puppets."
Beatallica formed in 2001 as a one-off Metallica tribute band for a local festival, but soon hit upon the idea of adapting Beatles songs to Metallica's heavy-metal format.
Dixon posted their songs online, attracting fan mail from all over the world. Dixon estimates that more than 1 million copies of the band's songs have been downloaded for free or traded through online file-sharing networks.
The band hired lawyers to make sure it did not run afoul of copyright and trademark laws.
But on February 24, Beatallica received a letter from Sony/ATV Music Publishing demanding that the band take down its Web site and pay Sony "an amount to be discussed."
"Such uses of Sony/ATV compositions without the express authorization or license has caused and continues to cause substantial and irreparable injury, and is in direct violation of Sony/ATV's rights," the letter said.
While the site remains offline, the band's songs can be easily found through offshore Web sites. Nearly 6,000 supporters have signed an online petition demanding Sony drop the case.
Dixon said the band had even created new Beatles fans.
"We've had many people who've written to the site, especially young headbangers, who have said, 'I've always hated the Beatles' music, but I think I'm going to check it out now,"' he said. "It's a bit of an outreach project crossing generations."

If your use is intended for your own commercial gain, it is less likely to fall under the category of fair use.
Free speech doesn’t necessarily protect all parody from copyright infringement. When “Weird Al” Yankovic parodies a popular song, he gets permission from and pays royalties to the original artist.

When METALLICA frontman James Hetfield was asked last year by Kerrang! magazine if he's ever heard BEATALLICA, he replied, "Yeah. I heard that. That was amazing. Someone put a lot of thought and talent into that man!" Asked if he was being sarcastic, he said, "No, not at all. I heard it online. It was about a year ago, or more. It was pretty amazing. It was pretty well thought out so I'm glad there's people like that in the world to do that and it's very entertaining for us, for sure!"

The Copyright Act in Section 107 allows "Fair Use" and the United States Supreme Court in Campbell v. Acuff-Rose Music, Inc. (1994) stated that a parody as a form of criticism or comment could be fair use of a copyrighted work. Oh, Pretty Woman written by Roy Orbison and William Dees. Luther Campbell and 2 Live Crew, wrote Pretty Woman that had substantial similarities to the Orbison/Dees song. The Supreme Court accepted 2 Live Crew's song as a parody because the rap song mimicked the original to achieve its message.
The Court determined that the purpose and character of the use, favored 2 Live Crew because a "parody has an obvious claim to transformative value" and the rap song was certainly transformative in that " it provid[ed] social benefit, by shedding light on an earlier work, and, in the process, creat[ed] a new one."

I believe that the 2 Live Crew Supreme Court should have settled that as Luther Campbell asked and was refused permission to use Pretty Woman and he still won his landmark parody case.
