Guys, I have to leave ILX

I was just pulled into my boss's office. They've figured out that I've been using Soulseek, writing music reviews and generally misusing the internet at work. They're suspending me till Friday and then I have to go in for a hearing where they'll decide what to do with me.
As far as I know there's nothing harmful on my hard drive - just music and a few word documents. There is a zipped version of Ghostzilla which I've never used but that I'm pretty worried about, and of course Soulseek.
I'm a fucking idiot obviously to think I wouldn't get caught. I guess I knew it would happen eventually - I'm self destructive that way. To be honest I can't bear the job, but it's better than no job at all. I'm hoping they're merciful - I'm going to be straight up with them in the hearing and then just hope they reconsider sacking me.
So now I'm going to spend the next souple of days firing off CVs to various companies. Right now it feels fruitless because any future employer who finds out I got dropped for misusing the internet is not going to be impressed and the hope of a reference from this company will be at it's minimum.
If anyone has any advice here I'd be very grateful. Till then I'm avoiding ILX and other addictive net things for a while. Hopefully I'll be back soon - oh and if any FAPs are going on, please tell me. My address is below.

anyway my advice is to be not at all defensive or overly apologetic. if you can get away with it, just play dumb. if you were never specifically told NOT to do any of these things, say you thought it was OK.

If your work performance is good otherwise, play that up.

You could try explaining yourself by saying that you've been having some personal problems or something and the ILXors are helping you through it and you just lost track of how long you were spending on it. Tell them it's been sorted now and you'll cut down.

Eveyone wastes time on the internet at work, my supervisor spends probably half his day looking at ESPN, other folks look at cars and motorcycles, whatever kind of news floats your boat. I'm lucky in that at least most of the sites I visit for my fix are geekish enough to be construed as work-related. There are a couple of coworkers here who will blatantly play videogames on their office machine or such as that but the worst I've ever done I think is try to listen to Ally's radio show. And play around with Visio to make stupid photo-comix and satirical network diagrams. I think that using Soulseek to trade and share copywritten material over the office broadband goes well above and beyond what I would do at work, though. ILX and wasting time on impertinent websites is one thing, and I think everybody has done that to some extent. Filesharing is another thing altogether, I mean I personally wouldn't fire you unless you were already on my shit list but I wouldn't exactly keep my voice down either.

Poor old dog latin. Filesharing (well, any software) is blocked from installation by end users at my office, so the tempatation hasn't been there. At an old job, without such restrictions, I used Napster and Audiogalaxy for a while. We got a company-wide note from IT about 4 users of Audiogalaxy using up 50% of our monthly bandwidth or something, but I don't think it was me as I didn't use it that much!

Did they make you sign an IT usage policy statement when you joined? That could make a big difference. I think it's a bit harsh to immediately sack someone without a warning, unless it's porn or something.

anyway, i would guess it's the file sharing that did it. file sharing has a moral taint to it which the boss could see as implicating him/her as well. i doubt this would have come up if it were just a matter of you visiting web sites a lot.

the place where i work has some kind of filter than blocks "offensive" or "inappropriate" content. but strangely it seems to function not at all. it will block totally innocuous film-critic sites (and robert christgau's site!) while all kinds of semi-pornographic pop ups will appear after visiting geocities or whatever.

That's treating someone like a child. If they have that much of a problem with it, they should block off access to certain things, or give a warning and that's it.

I had one of those 'hearings' at my first job out of college. It was because the u had a repeated sexual harasser in our office, and they wouldn't do anything about it, so we put a fake book in the online catalog - the title was 'Can I massage your feet' or something like that, with Mr. Sexual Harasser as the author. We got caught and had one of these 'hearings' in which they talked down to us the whole time.

At least some of these net-nanny programs depend on the site owner voluntarily filling out rating forms. Because they are 1) voluntary and 2) based on self-assessment, all too many nasties will keep cropping up.

Amateurist, I think you're being unfair - you have to remember that Britain has laws which safeguard people from getting fired without proper procedure and tribunals are common - everyone knows someone who has needed one at some point. So I guess "my world" is Britain, where if you are in a contract job you have plenty of rights and paths to recourse.

Also, I like you but you have really been a whiny mensch lately. What's up with that?

If DL were an otherwise blameless worker - or if the office culture appeared to him neutral about that sort of thing - he's probably within his rights to take action against the employer if sacked, UNLESS it's in his contract that he's not to do specific things on the internet.

That said if they are following a procedure then I expect he'll get a written warning about it. That's all they should be able to do if they've not had so much as a word to him against his work before now.

One thing he should NOT do is make excuses.

DL - they must show you the section of the code of conduct/staff handbook that pertains to internet abuse. They must have proof that they TOLD you that these rules exist i.e they gave you a copy to read and/or read and sign.

They must also go by the book in dismissing you - there willbe a procedure and they will have to use it and be seen to be using it. I doubt that you will get fired for this without a warning.

I would say as little as possible in the interview - let them do the talking and see what they know. Take a friend/trusted colleague in with you if you can. If you want to keep the job, probably an apology coupled with pointing out that you have in fact been doing your job as well would help.

Man DL I am sorry to hear this too, dude :( I agree with others though - Soulseek is the undoer. I work for a multinational telco and running filesharing is a massive no no. Raids have been done on places like Telstra and large universities recently by ARIA (the aust RIAA) so we're theoretically not even meant to have any mp3s on our machines (people do though, from their own cds).

The one other thing I can sort of see why this happened that no one seemeed to mention was you said you were doing reviews at work. IOW, you were working on another job in your work time.

That, more than anything, is unfortunately something I can see one getting a kick in the bum for.

My contract explicitly prohibits IRC and other online chat, of all things. They let us use MSN though the mentalists.

Good luck, dl. Hopefully all you'll get is a suspension and a warning telling you you shouldn't do that again. Hopefully they will allow you to express remorse about what you have done and committ to not doing it again. I, of course, refer to the file sharing, which has the biggest opportunity for getting your employers in some pretty big legal trouble. Obv everyone goes online at work to do various things, but the file sharing thing... boy, that's a big one. Would be best to try to delete Slsk and the music files on your computer. Once things cool down, hopefully you can return to posting to ILX and doing your music reviews, though obv it will be more difficult to do that without Slsk available (though I think it's still doable).

I go online at work, too, but only for "serious", academic-type reasons. On occasion I will sneak onto ILX, but I'm too fearful of getting caught by someone to actually do any real ILXing there.

DL, you should stress that you were 'sharing' music with friends (copyright-free stuff). As many people mentioned above your employees main worry may be that you're putting THEM in a legally dodgy situation. You could also stress that the dl'ing goes on in the background of what you were working on and doesn't take up much time at all. (Much less than web-surfing. I think the problem with Soulseek and filesharing in general is not only bandwidth but the fact that it opens up all sorts of dodgy network security issues as well - thats certainly why its banned in our office.

I bet this thread has made an awful lot of us look over their shoulders. It pays to be friends with the IT people - in my last job I asked the IT boss whether they check people's internet use, and he said that they might do if they had three times the staff. In my current job, the IT guy happens to be quite literally my oldest friend, which is handy - and also it's too small an operation to worry too much about this kind of thing.

If they do want to fire you, I'm sure there is justification in the fact that you were committing a crime (music theft) on their time and using their equipment. If they don't want to fire you, I'm sure they will use their discretion and give you a written warning.

The trick is always to *be* the IT person. That was the best, when I was the Sys Admin. If people pissed me off, I had total access to their email and their internet records and everything. Heh heh.

That is the best lesson that my father always taught me - always bow down to the Sys Admin and treat them as if they are your god. Because in a way, they are. At least they can wreck vengeful havoc on your life in the same way. ;-)

i think most IT depts don't care about general internet use, and bandwidth is rarely the issue. what they care about (or at least SHOULD) is policing the transferring of files in and out of the company network, and adherence to copyright. obv HTML files pretty harmless, music won't wreak virus havoc but is a copyright infringement (which all corps have an interest in preserving), and then general runnable software is a security hole.

The trick is always to *be* the IT person. That was the best, when I was the Sys Admin. If people pissed me off, I had total access to their email and their internet records and everything. Heh heh.

That didn't work at my last job. What didn't help was that my boss was in the same room, and learned, by listening to the sound of my typing, to tell whether I was doing sysadmin stuff, or posting on ILX/LJ/my blog. I got called aside a couple of times to be told I was spending too much time writing blog entries, or doing personal mail.

Of course, that was also the company that objected to me charging my phone at work ("we think it's a *little bit* cheeky of you to use our electricity like that"). I'm the "I.T. guy" here, never think that keeping the BW down will keep us at bay we routinely portscan for all major file sharing apps and come down heavily on those that use them.

1 way to avoid major problems is to remote desktop to an XP Pro machine at home if you have broadband and do everything through that, that way you are making an outgoing connection across one port and all the nasty illegal stuff is happening at your house, this of course doesn't stop the boss looking over your shoulder, but it does make minimizing it very easy all you have is one remote desktop window which shouldn't raise any warnings.

Even if your company stops 3389 (default RD port) you can setup RD to listen on port 80 (HTTP) and you should be okay.

Thanks for all the kind words and advice everyone. Only three hours to go before I find out my future. To be honest I'm not too worried if I keep the job or not, it's the reference I'm worried about. I already have two interviews lined up for next week.

I'm a fucking idiot for even trying to do what I did but I guess the way I saw it was I was making use of a 2MB broadband connection they were hardly using. Plus I didn't feel as though they were giving me enough work to do (although if I told them that, they'd probably have words to say on the subject). I felt expendable and bored and that made me fuck about. As soon as the workload picked up I'd sometimes find that it over took me - but only sometimes.

Oh well, I guess I just have to sit there and be surly, admit anything they ask and apologise profusely. I really don't think they're going to keep me, if they do it will be very weird indeed. They're a small local business and this kind of thing hasn't happened to them before so they don't know how to handle it.

Anyone got any tips on references and where to get them if they're refused from your last employer?

I'd say put your employer down anyway on your resume when you put it in! Put a few other references down along with and just hope. My last interview I gave two recent referees, knowing one would be polite but not that positive and the other would be glowing.

i'd be upfront as possible about your mistakes. both at the meeting and at any new interviews. especially regarding filesharing. ilx and review writing is only a big deal if your productivity sucked and you were late for a lot of things. seriously, from a wise management point of view, you need to air your brain out. constant work isn't good for a well-rounded employee. of course, that's assuming the management cares.

but if you're forthcoming with the details of what went wrong, it could help a little. it may put you in a probationary period of work where they see your output for 3 months and then go from there, but that may be what you have to do.

when you come into the meeting size up the mood. that's the most important thing. you might be able to see right away that there's not a goddamn thing you can do because they've already made up their minds. short of that, if you have any history of good vibes with them, and they seem like they're still discussing/reprimanding rather than firing, the most important thing is to get back on the same side as them, "one of them" rather than "the freak who must be controlled and/or expunged" . i personally would start things out with a guilty-as-hell hangdog grin.. if at all possible. followed by a no-holds-barred admission of the extent of your stupidity. followed by what you consider to be the real problem here, of which filesharing etc is but the merest consequence: that you had some dead spots in your day. you should have communicated that, and let them know, and you didn't, and THAT'S what you feel really guilty about

hell, at a couple state jobs i worked at, one dude was found with gigs of pr0n on his hard drive. and illegal stuff too. he was warned!!! 12 months later, when something was wrong with his computer and he had IT look at the machine, there were gigs more! finally, after much insanity, he was fired.

of course, some dude nearly assaulted somebody, was escorted out of the building, and then came back to work like nothing happened the next day. insanity!

so you never know what to expect. the sad part is that when your workplace tolerates that much, your ethic tends to slacken off. everybody there didn't give two shits because they knew it would be impossible to fire you and that sucks. especially when it's taxpayer money.

It's common practice that most companies (esp. large ones) only confirm employment. Saying much of anything else makes them liable. So I'm back. They made me come in an hour earlier than they'd said. Probably the longest 20 minutes of my life. They'd gone through my entire computer, found a few (non-porn) movies, music, reviews, a draft of jonathan ballsup's diary etc. They weren't impressed.

I basically did what Tracerhand suggested (I only just read what he wrote now). It still doesn't look good as I might have let slip that I'd been bored/disappointed at work.

They've given me all week to worry about it and then they're going to tell me on Monday (although they said it didn't bode well).

I just got a call from my boss. They've come to the conclusion that there is little hope for future devleopments between them and me, but rather than give me the sack they've given me the opportunity to resign. I asked about references and they said they'd give me one but if questioned would have to give the truth - fair do's I suppose. They also wished me luck in the future - in a nice way of course.

In many ways this is the best of all outcomes. I think if they'd offered me back the job I'd have resigned anyway seeing as the atmosphere would be weird and I wasn't really getting my teeth into the work. From now on I have to tread stealthy as a mothafucha. I've been pretty much glued to the internet and various forums since I got free internet at university and in many ways it's become a big distraction. In other ways it's helped me make a lot of friends, helped me promote my band and start up a small record label and get my writing to a larger audience. It hasn't helped my degree or worklife in any way though. That's the price you pay for being a mouse potato I guess. Hmmm... I wonder if the Daily Mail would like to hear my story of woe and internet addiction huh?

Anyway, I'll be popping my head in from time to time I guess, but really I think it would be best if I let things chill on the web front for a while.

Back in the glory days of Napster, I was chided a couple times at one job for being on the internet too much. The second time I sneered and said "I'm on my lunch break" (which I was) and she felt stupid (which she was).

The job after that was a contract job for fed. gov't and while I was doing work on one computer, I had another computer next to it downloading music, war3z, even a little pr0n!!1 from Hotline servers and was burning cds like a madman. Pretty sure the network guys could see all my "transactions" but I was never called out for it. They just let my contract expire naturally and gave me a hell of a letter of recommendation (which I still use today!).

Hi dere!

Okay, so admittedly I haven't quite yet left the fold, ILX being that kind of creature but I Do have an update - a positive one so yay! I've been offered a job doing sales in some place in Stevenage. The work seems a little crumby (sales? yeuch!) but but but - it pays a shit load more than anywhere else I've ever worked and it WON'T be forever. As soon as the overdraft is paid back and I have a little dollar (£) in me back pocket I have bigger and better plans which involve finding work in either London or pref Brighton.I've already talked with a good recruitment agency about this one and they're scouting around as I type (well maybe not NOW, it being 1.30am, but you know what I mean).
So yeh, good good good. As for right now, I have until October 4th to laze about and do nothing. I still intend to cut down my internet time because it was actually getting fucking silly. Plus new job resolution is to spend more time writing stuff (from home, not work) and less time procrastinating in the evenings and/or getting pissed.

As if.

But yeh, I was rather overwhelmed by all the support on this thread and I can only say thanks so much as I don't think I'd have had the motivation to go out and get another job without the knowledge of so many kind souls backing me up.

i've seen three people fired because of that.

been let go from one temp job for checking my email.

the boss used to check the employees internet history when you would leave the room.

but it was a crap job so i was happy to go.

remember folks: delete history, cookies and internet history at the end of each surfing day!

file sharing is harder to hide because it takes up tonnes of usage.

most computer people are just looking for porn site traffic. usually they are so understaffed that they can't monitor surfing habits. however, the smaller the company, the more wary you should be.

the computer department using the internet most is true to some extent. i guess i'm mainly thinking of big organisations such as finance and law firms the "reputation" of whom are valued very highly and they (especially coupled with the often more "proactive" (eegh) HR staff who think they run the show) are more likely to monitor things like internet usage rigidly.

I think it's just about attitude, not toughness (hope that makes sense).
Some people thought the 'bullying' of Louis was a new low for ILX.
I doubt anyone really thinks Wagemann was unfairly lambasted tho heh.
The general feeling seemed to be that they were going about things the wrong way, opening them up for criticism. But people's ideas of valid or fair criticism do differ. Again you could argue that just posting images or song lyrics isn't really criticism but otoh is it really so hard to deal with?
